2-p50 <br />I ,t 4,. w%uNt:IL THE CITY OF SANTA ANA, CALIFORNIA N-200 <br />AGREEMENT FOR ACQUISITION OF <br />REAL PROPERTY AND ESCROW INSTRUCTIONS <br />e� THIS AGREEMENT, entered into this Loday of M IQ y , 2001„.by and between the CITY OF <br />SANTA ANA, a charter city and municipal corporation duly organized under the Constitution and laws of the <br />State of California (hereinafter referred to as the"City"), the JOHN C. HALL TRUST DATED DECEMBER <br />19, 2001 (hereinafter called "Seller"), regardless of number or gender; <br />RECITALS <br />1. The City is acquiring a portion of the real property located at 13972 N. Tustin Avenue from Seller <br />for the express purpose of widening 17' Street in front of the subject property and it is the City's <br />sole responsibility to undertake and complete said street widening in a timely manner, including <br />construction of the planned sidewalk, traffic signalization, curb and gutters and drainage <br />improvements. City herein confirms that Seller shall incur no expense for the relocation of power <br />poles to their ultimate location. <br />2. Seller agrees to pay City for the "incremental" cost to relocate the traffic signal currently residing <br />at the northeast corner of the intersection of 17' Street and Tustin Avenue to its "ultimate" <br />location. Said incremental costs are estimated to be $10,000. <br />3. City agrees, as part of this transaction, to allow the Seller or Seller's tenant to hook-up to City's <br />sewer system on 17' Street. City agrees that, should no a sewer lateral exist, City shall construct <br />a sewer lateral, and pay for the first $5,000 of the cost thereof, with the Seller being responsible <br />for any cost in excess of $5,000. <br />WITNESSETH <br />Given the above and in consideration of their promises, covenants and agreements hereinafter set forth, and <br />subject to the terms, conditions and provisions hereinafter set forth, Seller agrees to sell to City, and City <br />agrees to purchase from Seller, all that certain real property (hereinafter referred to as "said real property") <br />described as follows: <br />All that certain real property located in the State of California, County of Orange, City of Santa Ana, <br />described as follows: <br />SEE EXHIBIT "A" ATTACHED HERETO <br />AND BY THIS REFERENCE MADE A PART HEREOF <br />(Commonly known as 13972 N. Tustin Avenue, Santa Ana, CA) <br />Said sale and purchase of said real property shall be in accordance with and subject to all of the following <br />terms, conditions, promises, covenants, agreements and provisions, to wit: <br />I. Conveyance by Seller. Seller agrees to convey said real property to City, by Grant Deed, at the office <br />of First American 'Title Insurance Company, 2 First American Way, Santa Ana, California, within thirty (30) <br />days from and after the date on which the City has approved this Agreement. <br />1 <br />
