PROCEED CLERK OF COUNCIL DATE; JUL D 5 2018 V 1 0 0) FIRST AMENDMENT TO NON-EXCLUSIVE AGREEMENT C"41 -> TO PROVIDE CARNIVALS AT CITY PARKS THIS FIRST AMENDMENT to the above -referenced agreeipent is entered into on June 19, 2018, by and between Fiesta de Carnival, a California corporation ("Operator"), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California ("City' }. RECITALS A. The parties entered into Agreement #A-2018-019, dated February 6, 2018 ("Agreement"), by which Consultant agreed to provide carnivals at specified City owned parks. A schedule of events was agreed upon by the parties and was attached to the Agreement as Exhibit A. B. Operator informed the City of a request to reschedule the event for Rosita Park, previously listed for June 1-3, 2018 due to a scheduling issue with the ride operator. City staff agreed to the request to reschedule the event for the weekend of September 7-9, 2018. C. The parties wish to amend the Agreement to memorialize this change in dates for the carnival at Rosita Park. No other changes to the Agreement are contemplated. The Parties therefore agree: 1. Section la, Scope of Services, is amended to recognize a revision to Exhibit A as to the Park Site and 2018 Dates. Line 4 for the Rosita Park event will now be scheduled for September 7- 9,2018. 2. Except as modified by this First Amendment, all terms and conditions of the Agreement shall remain in full force and effect.
