D. On July 23, 2018, during the 45 day public comment period, the Planning <br />Commission held a duly noticed public hearing and voted to recommend <br />that the City Council adopt a resolution certifying Subsequent Final <br />Environmental Impact Report No. 2018-15 (SCH No. 2006031041) and <br />approving the Mitigation Monitoring and Reporting Program, Findings of <br />Fact and Statement of Overriding Considerations; General Plan <br />Amendment No. 2018-03; Amendment Application No. 2018-06; and <br />Zoning Ordinance Amendment No. 2018-02 for the Metro East Mixed Use <br />Overlay Zone expansion and amendments project. <br />E. The certification of the SEIR is a CEQA Determination by the City Council. <br />The discretionary approval of the MEMU and Elan projects requires <br />separate actions by the appropriate approving bodies. <br />F. On August 21, 2018, the City Council of the City of Santa Ana held a duly <br />noticed public hearing to consider all testimony, written and oral, related to <br />Subsequent Final Environmental Impact Report No. 2018-15 (SCH No. <br />2006031041), General Plan Amendment No. 2018-03, Amendment <br />Application No. 2018-06; and Zoning Ordinance Amendment No. 2018-02 <br />for the Metro East Mixed Use Overlay Zone expansion and amendments <br />project, :at which time all persons wishing to testify were heard, the project <br />was fully considered, and all other legal prerequisites to the adoption of <br />this Resolution occurred. <br />G. Pursuant to the California Environmental Quality Act (Pub. Res. Code sec. <br />21000 et seq.; "CEQA"), and the State CEQA Guidelines the City has <br />determined that a Subsequent Environmental Impact Report (SEIR) <br />should be prepared pursuant to CEQA in order to analyze all potential <br />adverse environmental impacts of the proposed project. <br />1. Pursuant to Public Resources Code section 21067 and the State <br />CEQA Guidelines (Cal. Code Reg., tit. 14 Sec 15000 et seq.) <br />section 15051, the City is the lead agency for the proposed Project. <br />2. In accordance with CEQA, the recommended actions have been <br />reviewed through an SEIR. Sections 15080 through 15097, and <br />15162 of the State CEQA Guidelines (Article 7) guide the process <br />for the preparation of an EIR and an SEIR. <br />3. The California Environmental Quality Act (CEQA) requires that, <br />where there is the potential for environmental impacts as the result <br />of a proposed project, an EIR be prepared in order to study and <br />Resolution No. 2018-xx <br />Page 2 of 13 75A-126 <br />
