(5) Changes in property taxes or other taxes related to the subject mobile <br />home park. <br />(6) Changes in the rent paid by the applicant for the lease of the land on <br />which the subject mobile home park is located. <br />(7) Changes in the utility charges for the subject mobile home park paid by <br />the applicant, and the extent, if any, of reimbursement from the tenants. <br />(8) Changes in reasonable operating and maintenance expenses. <br />(9) The need for repairs caused by circumstances other than ordinary wear <br />and tear. <br />(10) The amount and quality of services provided by the ,applicant to the <br />affected tenant(s). <br />(11) Any existing written lease lawfully entered <into 'between the applicant and <br />the affected tenant(s). <br />An application for a fair return adjustment shall be decided by the City Manager within <br />sixty (60) calendar days of the date that the application has been deemed complete. <br />The decision shall be emailed and sent by mail, with proof of mailing to the mobile home <br />park owner, the park owner's designated representative(s) for the petition, and a <br />designated representative of the residents. Any appeal of the City Manager decision on <br />an application for a fair return adjustment shall proceed pursuant to the administrative <br />appeal procedures found in Chapter 3 of the SAMC. <br />Section 7. Pursuant to the 'MRL, the provisions of this interim ordinance <br />regulating the amount of rent that a mobile home park owner may charge for a mobile <br />home space shall not apply to the following: any mobile home space subject to a long <br />term (more than one year) rental agreement (California Civil Code section 798.17); any <br />newly constructed mobile home space first offered for rent on or after January 1, 1990 <br />(California Civil Code section 798.45); and, mobile homes not being used as a person's <br />primary residence that are not being leased to someone else (California Civil Code <br />section 798.21) <br />Section 8. This ordinance shall have no further force and effect forty-five (45) <br />days from the date of its adoption; unless, however, after public hearing the City Council <br />members, by four -fifths (4/5) vote, extend this ordinance for an initial period of ten (10) <br />months and fifteen (15) days. Subsequently, after public hearing, the City Council <br />members, by four -fifths (4/5) vote, may then extend this ordinance one additional year. <br />Section 9. It shall be unlawful and a misdemeanor for any person to violate or <br />fail to comply with any provision of the ordinance. The violation of any provision of this <br />ordinance shall be punished as provided in SAMC section 1-8. <br />272 <br />65A-275 <br />
