need to provide protection for tenants against actual or constructive eviction as a <br />result of the high cost of moving and installing mobile homes, allowing owners of <br />mobile home parks to impose unrestricted rent increases could displace a large <br />number of elderly, fixed -income, or low and moderate -income Santa Ana <br />residents. <br />Q. Accordingly, the proposed ordinance addresses the preservation of the public <br />peace, health, safety and welfare based on the Following facts: <br />1. Housing costs continue to escalate in Orange County, and mobile home <br />parks serve as an important affordable housing option for Santa Ana <br />residents; <br />2. Since a mobile home is affixed to the property on which it resides, it is <br />generally not cost effective to move it, resulting in the owner losing the mobile <br />home if he or she cannot pay the rent imposed .by the landlord; <br />3. Significant mobile home space rent increases have been proposed in at least <br />two (2) mobile home parks in Santa Ana, and such increases threaten the <br />economic and social stability of the City's elderly and low income residents; <br />4. Absent the adoption of this ordinance,, as a result of the economic conditions <br />and recognized housing shortage in Southern California, significant rent <br />increases will impact a substantial number of mobile home residents in Santa <br />Ana and constitute >a threat to public health, safety and welfare, and a <br />particular hardship for, senior citizens, persons living on fixed incomes, and <br />other vulnerable persons living in mobile, home parks in Santa Ana; and, <br />5. Certain aspects of public health, safety and welfare are not adequately <br />protected due to the lack ofmobile home space rent stabilization mechanics <br />or controls in Santa Ana. <br />R. The proposed ordinance would put in place a restriction on any adjustment of <br />mobile home space rent in Santa Ana in excess of three percent (3%), or the <br />change in the Consumer Price Index, whichever is greater. <br />S. The Request for Council Action for this ordinance dated May 21, 2019, shall be <br />incorporated herein by this reference, and together with this ordinance, any <br />amendments or supplements, and oral testimony, shall constitute the necessary <br />findings for this ordinance. <br />T. The City Council finds, determines and declares that the threat to the public <br />health, safety and welfare of the City and its citizens necessitates the enactment <br />of the ordinance. <br />Ordinance No. INS - _ <br />Page: of 8 <br />278 <br />65A-281 <br />
