Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) ENVIRONMENTAL IMPACT REPORT <br /> <br />sufficient information in the entire record to determine whether any boundary of the school site <br />is within 500 feet of the edge of the closest traffic lane of a freeway or other busy traffic corridor. <br />If it is determined that the project involves the acquisition of a school site that is within <br />500 feet of the edge of the closest traffic lane of a freeway, or other busy traffic corridor, the <br />Negative Declaration, Mitigated Negative Declaration, or EIR may not be adopted or certified <br />unless the school board determines, through a health risk assessment pursuant to Section <br />44360(b)(2) of the Health and Safety Code and after considering any potential mitigation <br />measures, that the air quality at the proposed project site does not present a significant health risk <br />to pupils. <br />7.37 S TATEMENT OF O VERRIDING C ONSIDERATIONS. <br />Before a project that has unmitigated significant adverse environmental effects can be <br />approved, the decision-making body must adopt a Statement of Overriding Considerations. If <br />the decision-making body finds in the Statement of Overriding Considerations that specific <br />benefits of a proposed project outweigh the unavoidable adverse environmental effects, the <br /> <br />Accordingly, the Statement of Overriding Considerations allows the decision-making <br />body to approve a project despite one or more unmitigated significant environmental impacts <br />identified in the Final EIR. A Statement of Overriding Considerations can be made only if <br />feasible project alternatives or mitigation measures do not exist to reduce the environmental <br />impact(s) to a level of insignificance and the benefits of the project outweigh the adverse <br />environmental effect(s). The feasibility of project alternatives or mitigation measures is <br />determined by whether the project alternative or mitigation measure can be accomplished within <br />a reasonable period of time, taking into account economic, environmental, social, legal and <br />technological factors. <br />Project benefits that are appropriate to consider in the Statement of Overriding <br />Considerations include the economic, legal, environmental, technological and social value of the <br />project. The City may also consider region-wide or statewide environmental benefits. <br />Substantial evidence in the entire record must justify the decision- <br />and its use of the Statement of Overriding Considerations. If the decision-making body makes a <br />Statement of Overriding Considerations, the Statement must be included in the record of the <br />project approval and it should be referenced in the Notice of Determination. <br />7.38 M ITIGATION M ONITORING OR R EPORTING P ROGRAM FOR EIR. <br />When making findings regarding an EIR, the City must do all of the following: <br />(a) Adopt a reporting or monitoring program to assure that mitigation measures that are <br />required to mitigate or avoid significant effects on the environment will be implemented <br />by the project proponent or other responsible party in a timely manner, in accordance <br />with conditions of project approval; <br />(b) Make sure all conditions and mitigation measures are feasible and fully enforceable <br />through permit conditions, agreements, or other measures.
