Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) ENVIRONMENTAL IMPACT REPORT <br /> <br />7.40 D ISPOSITION OF A F INAL EIR. <br />The City shall file a copy of the Final EIR with the appropriate planning agency of any <br />city or county where significant effects on the environment may occur. The City shall also retain <br />one or more copies of the Final EIR as a public record for a reasonable period of time. Finally, <br />for private projects, the City may require that the project applicant provide a copy of the certified <br />Final EIR to each Responsible Agency. <br />7.41 P RIVATE P ROJECT C OSTS. <br />For private projects, the person or entity proposing to carry out the project shall be <br />charged a reasonable fee to recover the estimated costs incurred by the City in preparing, <br />circulating, and filing the Draft and Final EIRs, as well as all publication costs incident thereto. <br />7.42 F ILING F EES FOR P ROJECTS T HAT A FFECT W ILDLIFE R ESOURCES. <br />At the time a Notice of Determination for an EIR is filed with the County or Counties in <br />which the project is located, a fee of $3,271.00, or the then applicable fee, shall be paid to the <br />Clerk for projects that will adversely affect fish or wildlife resources. These fees are collected <br />by the Clerk on behalf of DFW. <br />Only one filing fee is required for each project unless the project is tiered or phased and <br />separate environmental documents are prepared. For projects where Responsible Agencies file <br />separate Notices of Determination, only the Lead Agency is required to pay the fee. <br />Note: County Clerks are authorized to charge a documentary handling fee for each <br />project in addition to the Fish and Wildlife fees specified above. Refer to the Index in the Staff <br />Summary to help determine the correct total amount of fees applicable to the project. <br />For private projects, the City should pass these costs on to the project applicant. <br />certain projects undertaken by the DFW and implemented through a contract with a non-profit <br />entity or local government agency.
