Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) TYPES OF EIRS <br /> <br />environmental effect and that no new mitigation measures or alternatives may be required, it may <br />prepare written findings to that effect without preparing a new environmental document. When <br />the Lead Agency makes this finding, it must provide public notice of the availability of its <br />proposed finding for public review and comment in the same manner as if it were providing <br />public notice of the availability of a draft EIR. (See Sections 15177(d) and 15087 of the State <br />CEQA Guidelines and Section 7.25 of these Local Guidelines.) <br />A previously certified Master EIR cannot be relied upon to limit review of a subsequent <br />project if: <br />(a) A project not identified in the certified Master EIR has been approved and that project <br />may affect the adequacy of the Master EIR for the subsequent project now under <br />consideration; or <br />(b) The Master EIR was certified more than five (5) years before the filing of an application <br />for the subsequent project, unless the City reviews the adequacy of the Master EIR and: <br />(1) Finds that, since the Master EIR was certified, no substantial changes <br />have occurred that would cause the subsequent project to have significant <br />environmental impacts, and there is no new information that the <br />subsequent project would have significant environmental impacts; or <br />(2) Prepares an Initial Study and either certifies a Subsequent or <br />Supplemental EIR or adopts a Mitigated Negative Declaration that <br />addresses any substantial changes or new information that would cause <br />the subsequent project to have potentially significant environmental <br />impacts. The certified subsequent or supplemental EIR must either be <br />incorporated into the previously certified Master EIR or the City must <br />identify any deletions, additions or other modifications to the previously <br />certified Master EIR in the new document. The City may include a <br />section in the subsequent or supplemental EIR that identifies these <br />changes to the previously certified Master EIR. <br />When the Lead Agency cannot find that the subsequent project will have no additional <br />significant environmental effect and no new mitigation measures or alternatives will be required, <br />it must prepare either a Mitigated Negative Declaration or an EIR for the subsequent project. <br />8.12 F OCUSED EIR. <br />A Focused EIR is an EIR for a subsequent project identified in a Master EIR. It may be <br />used only if the City -inducing, and <br />irreversible significant environmental effects is adequate for the subsequent project. The <br />Focused EIR must incorporate by reference the Master EIR. <br />The Focused EIR must analyze additional significant environmental effects not addressed <br />in the Master EIR and any new mitigation measures or alternatives not included in the Master <br />-specific effects on <br />the environment that were not addressed as significant effects on the environment in the Master <br />EIR. <br /> <br />2019 City of Santa Ana Local Guidelines 8-7 ©Best Best & Krieger LLP <br /> <br />
