Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) NEGATIVE DECLARATION <br /> <br />The City requires requests for notices to be in writing and to be renewed annually. If the <br />City is not otherwise required by CEQA or another regulation to provide notice, the City may <br />charge a fee for providing notices to individuals or organizations that have submitted written <br />requests to receive such notices, unless the request is made by another public agency. <br />If the Negative Declaration or Mitigated Negative Declaration has been submitted to the <br />State Clearinghouse for circulation, the public review period shall be at least as long as the <br />period of review by the State Clearinghouse. (See Local Guidelines Section 6.10.) Day one of <br />the state review period shall be the date that the State Clearinghouse distributes the document to <br />state agencies. If the Lead Agency is submitting a Negative Declaration or Mitigated Negative <br />Declaration to the State Clearinghouse, the Notice of Completion form may be used. <br />The Notice of Intent to Adopt a Negative Declaration or Mitigated Negative Declaration <br />shall contain the following information: <br />(a) The period during which comments shall be received; <br />(b) The date, time and place of any public meetings or hearings on the proposed project; <br />(c) A brief description of the proposed project and its location; <br />(d) The address where copies of the proposed Negative Declaration or Mitigated Negative <br />Declaration and all documents incorporated by reference in the proposed Negative <br />Declaration or Mitigated Negative Declaration are available for review; <br />(e) A description of how the proposed Negative Declaration or Mitigated Negative <br />Declaration can be obtained in electronic format; <br />(f) <br />located, if <br />(see Local Guidelines Section 2.04); and <br />(g) The significant effects on the environment, if any, anticipated as a result of the proposed <br />project. <br />6.05 P ROJECTS A FFECTING M ILITARY S ERVICES; D EPARTMENT OF D EFENSE <br />N OTIFICATION. <br />CEQA imposes additional requirements to provide notice to potentially affected military <br />agencies when: <br />(a) The project meets one of the following three criteria: <br />(1) The project includes a general plan amendment; <br />(2) The project is of statewide, regional, or area-wide significance; or <br />(3) The project relates to a public use airport or certain lands surrounding a public use <br />airport; and <br />(b) 11.42 of these Local Guidelines) has provided its <br />contact office and address and notified the Lead Agency of the specific boundaries of a <br />-11.37 <br /> <br />2019 City of Santa Ana Local Guidelines 6-3 ©Best Best & Krieger LLP <br /> <br />
