Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) NEGATIVE DECLARATION <br /> <br />(c) Direct mailing to owners and occupants of property contiguous to the project, as shown <br />on the latest equalized assessment roll. <br />The City, when acting as Lead Agency, shall consider all comments received during the <br />public review period for the Negative Declaration or Mitigated Negative Declaration. For a <br />Negative Declaration or Mitigated Negative Declaration, the City is not required to respond in <br />writing to comments it receives either during or after the public review period. However, the <br />City may provide a written response to all comments if it will not delay action on the Negative <br />Declaration or Mitigated Negative Declaration, since any comment received prior to final action <br />on the Negative Declaration or Mitigated Negative Declaration can form the basis of a legal <br />challenge. A written response that refutes the comment or adequately explains the City <br />in light of the comment will assist the City in defending against a legal challenge. The City shall <br />notify any public agency that comments on a Negative Declaration or Mitigated Negative <br />Declaration of the public hearing or hearings, if any, on the project for which the Negative <br />Declaration or Mitigated Negative Declaration was prepared. <br />6.11 S UBMISSION OF N EGATIVE D ECLARATION OR M ITIGATED N EGATIVE D ECLARATION TO <br />S TATE C LEARINGHOUSE. <br />A Negative Declaration or Mitigated Negative Declaration must be submitted to the State <br />Clearinghouse for circulation in the following situations: <br />(a) The Negative Declaration or Mitigated Negative Declaration is prepared by a Lead <br />Agency that is a state agency; <br />(b) The Negative Declaration or Mitigated Negative Declaration is prepared by a public <br />agency where a state agency is a Responsible Agency, Trustee Agency, or otherwise has <br />jurisdiction by law with respect to the project; or <br />(c) The Negative Declaration or Mitigated Negative Declaration is for a project identified in <br />State CEQA Guidelines Section 15206 as being of statewide, regional, or area-wide <br />significance. <br />State CEQA Guidelines Section 15206 identifies the following types of projects as being <br />examples of projects of statewide, regional, or area-wide significance that require submission to <br />the State Clearinghouse for circulation: <br />(1) Projects that have the potential to cause significant environmental effects beyond <br />the city or county where the project would be located, such as: <br />(a) Residential development of more than 500 units; <br />(b) Commercial projects employing more than 1,000 persons or covering <br />more than 500,000 square feet of floor space; <br />(c) Office building projects employing more than 1,000 persons or covering <br />more than 250,000 square feet of floor space; <br />(d) Hotel or motel development of more than 500 rooms; or <br />(e) Industrial projects housing more than 1,000 persons, occupying more than <br />40 acres of land, or covering more than 650,000 square feet of floor area; <br /> <br />2019 City of Santa Ana Local Guidelines 6-9 ©Best Best & Krieger LLP <br /> <br />
