Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) NEGATIVE DECLARATION <br /> <br />6.20 N OTICE OF D ETERMINATION ON A P ROJECT FOR W HICH A P ROPOSED N EGATIVE OR <br />M ITIGATED N EGATIVE D ECLARATION H AS B EEN A PPROVED. <br />After final approval of a project for which a Negative Declaration or Mitigated Negative <br />Declaration has been prepared, Staff shall cause to be prepared, filed, and posted a Notice of <br />information: <br />(a) An identification of the project, including the project title as identified on the proposed <br />Negative Declaration or Mitigated Negative Declaration, location, and the State <br />Clearinghouse identification number for the proposed Negative Declaration or Mitigated <br />Negative Declaration if the Notice of Determination is filed with the State Clearinghouse; <br />(b) For private projects, identification of the person undertaking a project that is supported, <br />in whole or in part, through contracts, grants, subsidies, loans, or other forms of <br />assistance from one or more public agencies or the identity of the person receiving a <br />lease, permit, license, certificate, or other entitlement for use from one or more public <br />agencies; <br />(c) A brief description of the project; <br />(d) The name of the City and the date on which the City approved the project; <br />(e) The determination of the City that the project will not have a significant effect on the <br />environment; <br />(f) A statement that a Negative Declaration or Mitigated Negative Declaration was adopted <br />pursuant to the provisions of CEQA; <br />(g) A statement indicating whether mitigation measures were made a condition of the <br />approval of the project, and whether a mitigation monitoring plan/program was adopted; <br />and <br />(h) The address where a copy of the Negative Declaration or Mitigated Negative Declaration <br />may be examined. <br />The Notice of Determination shall be filed with the Clerk of each county in which the <br />project will be located within five (5) working days of project approval. <br />The City is encouraged to make copies of filed notices available in electronic format on <br />the Internet. Such electronic notices are in addition to the posting requirements of the State <br />CEQA Guidelines and the Public Resources Code. The Clerk must post the Notice of <br />Determination within twenty-four (24) hours of receipt. The Notice must be posted in the office <br />of the Clerk for a minimum of thirty (30) days. Thereafter, the Clerk shall return the notice to <br />the City with a notation of the period it was posted. The City shall retain the notice for not less <br />than twelve (12) months. If the project requires discretionary approval from any State agency, <br />the Notice of Determination shall also be filed with OPR within five (5) working days of project <br />approval along with proof of payment of the DFW fee or a no effect determination form from the <br />DFW (see Local Guidelines Section 6.24). Simultaneously with the filing of the Notice of <br />Determination with the Clerk, Staff shall cause a copy of the Notice of Determination to be <br />posted at City Offices. <br />If a written request has been made for a copy of the Notice prior to the date on which the <br />City adopts the Negative Declaration or Mitigated Negative Declaration, the copy must be <br /> <br />2019 City of Santa Ana Local Guidelines 6-15 ©Best Best & Krieger LLP <br /> <br />
