Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) NEGATIVE DECLARATION <br /> <br />(1) The project will have one or more significant effects not discussed in the previous <br />EIR or Negative Declaration; <br />(2) Significant effects previously examined will be substantially more severe than <br />shown in the previous EIR; <br />(3) Mitigation measure(s) or alternative(s) previously found not to be feasible would <br />in fact be feasible and would substantially reduce one or more significant effects <br />of the project, but the project proponents declined to adopt the mitigation <br />measure(s) or alternative(s); or <br />(4) Mitigation measure(s) or alternative(s) which are considerably different from <br />those analyzed in the previous EIR would substantially reduce one or more <br />significant effects on the environment, but the project proponents decline to adopt <br />the mitigation measure(s) or alternative(s). <br />The City, as Lead Agency, would then determine whether a Subsequent EIR, <br />Supplemental EIR, Subsequent Negative Declaration, Subsequent Mitigated Negative <br />Declaration, or Addendum would be applicable. Subsequent Negative Declarations and <br />Mitigated Negative Declarations must be given the same notice and public review period as other <br />Negative Declarations. The Subsequent Negative Declaration shall state where the previous <br />document is available and can be reviewed. <br />6.23 P RIVATE P ROJECT C OSTS. <br />For private projects, the person or entity proposing to carry out the project shall bear all <br />costs incurred by the City in preparing the Initial Study and in preparing and filing the Negative <br />Declaration or Mitigated Negative Declaration and Notice of Determination. <br />6.24 F ILING F EES FOR P ROJECTS T HAT A FFECT W ILDLIFE R ESOURCES. <br />At the time a Notice of Determination for a Negative Declaration or Mitigated Negative <br />Declaration is filed with the County or Counties in which the project is located, a fee of <br />$2,354.75, or the then applicable fee, shall be paid to the Clerk for projects that will adversely <br />affect fish or wildlife resources. These fees are collected by the Clerk on behalf of DFW <br />pursuant to Fish and Game Code Section 711.4. <br />Only one filing fee is required for each project unless the project is tiered or phased and <br />separate environmental documents are prepared. (Fish & Game Code Section 711.4(g).) For <br />projects where Responsible Agencies file separate Notices of Determination, only the Lead <br />Agency is required to pay the fee. <br />Note: County Clerks are authorized to charge a documentary handling fee for each <br />project in addition to the Fish and Game Code fees specified above.
