4.6 Santiago Park. OWNER has made certain requests of CITY related <br />to the use of Santiago Park for ingress and egress to the Project. In consideration for <br />the use of certain roadways to access the Project, as more particularly <br />described/depicted on Exhibit F, OWNER shall do the following: <br />4.6.1 Any park property utilized for access into the Project shall be replaced <br />with equivalent land (equal in size and appraised value) as required by the LWCF Grant <br />Conditions. <br />4.6.2 OWNER shall, at OWNER’s sole cost and expense, prepare any and all <br />documents required by the LWCF Grant for review and submission to the State of California; <br />4.7 Affordable Family Housing Units and Affordable <br />Housing Project Contribution. Project shall comply with the requirements of <br />the Housing Opportunity Ordinance (the “HOO”) in effect on the Effective <br />Date. In addition to the HOO fee amount applicable under the HOO, Owner <br />shall contribute an additional amount equivalent to _____ percent (____%) of <br />the HOO fee amount to further the goal of creating affordable housing within <br />the City (the “Affordable Contribution”). Fifty percent (50%) of the total <br />HOO fee and of the Affordable Contribution shall be paid prior to issuance of <br />the building permit. The remaining fifty percent (50%) of the HOO fee and of <br />the Affordable Contribution shall be paid prior to final approval sign-offs by <br />the City and issuance of the certificate of occupancy. Owner shall make no <br />requests to the City regarding any proposed use of the HOO fee and of the <br />Affordable Contribution made by Owner. The use the HOO fee and of the <br />Affordable Contribution is at the City’s sole and absolute discretion. <br />4.8 Overcrowding Mitigation Implementation Plan. The City <br />of Santa Ana has one of the highest average number of people per household in the <br />nation at 4.34 people per household. Owner commits to limit occupancy of the <br />residential units within the project site to levels in compliance with local, state and <br />federal fair housing standards. Prior to applying to the City for occupancy permit, the <br />Owner shall submit to the City an Overcrowding Mitigating Implementation Plan. <br />Prior to changing or revising the implementation plan, Owner shall provide a 60-day <br />minimum written notice to the City Community Development Agency and the <br />Planning and Building Safety Agency informing of any proposed changes or <br />revisions. <br />4.9 Local Live-Work Preference. Prior to issuance of any <br />Building Permits, OWNER shall develop and submit to the City Manager or his/her <br />designee, a local live-work plan for the Project targeting, to the extent feasible, a <br />preference or priority for persons who currently either live or work in the City of Santa <br />Ana for the rental of units at the Project. <br />4.10 Local Sourcing Plan. Developer agrees to make a good <br />faith effort to encourage contractors and suppliers to hire and procure locally, to the <br />extent that it is cost effective and does not delay the overall project development <br />schedule.
