Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) NEGATIVE DECLARATION <br /> <br /> <br />2019 City of Santa Ana Local Guidelines 6-2 ©Best Best & Krieger LLP <br />(1) Any water supply agency consulted under Local Guidelines Section 5.16; <br />(2) Any city or county bordering on the project area; <br />(3) For a project of statewide, regional, or area-wide significance, to any transportation <br />agencies or public agencies which have major local arterials or public transit <br />facilities within five (5) miles of the project site or freeways, highways, or rail <br />transit service within ten (10) miles of the project site which could be affected by <br />the project; and <br />(4) For a subdivision project located within one mile of a facility of the State Water <br />Resources Development System, to the California Department of Water Resources; <br />(c) The last known name and address of all organizations and individuals who have previously <br />filed a written request with the City to receive these Notices; <br />(d) For certain projects that may impact a low-level flight path, military impact zone, or special <br />use airspace and that meet the other criteria of Local Guidelines Section 6.05, to the <br />specified military services contact; <br />(e) For certain projects that involve the construction or alteration of a facility anticipated to <br />include hazardous air emissions or handle hazardous substances within one-quarter mile of <br />a school and that meet the other requirements of Local Guidelines Section 6.06, to any <br />potentially affected school district; <br />(f) For certain waste-burning projects that meet the requirements of Local Guidelines Section <br />5.11 (regarding mandatory preparation of EIR) (see also Local Guidelines Section 7.27), <br />to the owners and occupants of property within one-fourth mile of any parcel on which the <br />project will be located; and <br />(g) For a project that establishes or amends a redevelopment plan that contains land in <br />agricultural use, notice shall be provided to the agricultural and farm agencies and <br />organizations specified in Health and Safety Code Section 33333.3. <br /> <br />Additionally, for a project of statewide, regional, or area-wide significance, the Lead <br />Agency should also consult with public transit agencies with facilities within one-half mile of the <br />proposed project. <br /> <br />A copy of the proposed Negative Declaration or Mitigated Negative Declaration and the <br />Initial Study shall be attached to the Notice of Intent to Adopt that is sent to every Responsible <br />Agency and Trustee Agency concerned with the project and every other public agency with <br />jurisdiction by law over resources affected by the project. <br /> <br />The Notice of Intent to Adopt a Negative Declaration (Form “D”) must be filed and posted <br />with the County Clerk at least twenty (20) days—or, in cases subject to review by the State <br />Clearinghouse, posted by the County Clerk and the State Office and Planning and Research at least <br />thirty (30) days—before the final adoption of the Negative Declaration or Mitigated Negative <br />Declaration by the decision-making body (see Local Guidelines Section 6.10). <br />The City requires requests for notices to be in writing and to be renewed annually.
