Authorize the City Manager to execute an agreement with BNSF Railway Company to <br />construct railroad crossing enhancements on Dyer Road, for the term commencing <br />September 17, 2019, and ending upon construction completion, for the estimated cost of <br />$296,940, subject to non -substantive changes approved by the City Manager and City <br />Attorney. <br />2. Authorize the City Manager to execute a reimbursement agreement with the Developer, <br />PR/Broadstone Heritage I LLC, whereby the Developer agrees to pay the City for all costs <br />related to the construction of railroad crossing enhancements on Dyer Road, for the term <br />commencing September 17, 2019, and ending upon completion of all work and all <br />reimbursements are paid in full, subject to non -substantive changes approved by the City <br />Manager and City Attorney. <br />Approve an appropriation adjustment recognizing a Developer deposit of $296,940 into the <br />Select Street Construction, Developer Contributions In Lieu revenue account, and <br />appropriating the same amount into the Select Street Construction, Contract Services - <br />Professional expenditure account. <br />DISCUSSION <br />PR/Broadstone Heritage I LLC (Developer) is proposing to build a mixed -use development <br />consisting of 1,400 residential units and 18,000 square feet of commercial space at 2001 East Dyer <br />Road. Among a number of public improvements required of the development, a modification is <br />needed to the railroad crossing on Dyer Road between Red Hill Avenue and Pullman Street (U.S. <br />DOT Crossing 026711U -Exhibit 1). This modification triggers other upgrades to BNSF Railway <br />20B-1 <br />
