(2) Security patrol in the residential neighborhood and Santiago Park <br />a. patrol area: Project, Park Santiago and Park Santiago area <br />as depicted on attached Exhibit "IT' <br />b. Type of patrol: Periodic roving security twenty four (24) <br />hours a day. <br />e. Term: 55 years subieet to annual review during which <br />review it may be detennined that such tens shall end earlier. <br />(d) Park Santiago Publie Improvements and Traffic <br />Calming. Subject to the approval by the Executive Director of Publie Works Agency <br />and the Executive Direetorof Planning and Building Agency and meeting City design <br />specifications and standards, OWNER shall design and construct the public <br />improvements identified below prior to final approval for occupancy or the issuance <br />of a Certificate of Occupancy. Owner shall be solely responsible for all aspects of the <br />public improvements including, but not limited to, the analysis, design, engineering, <br />construction and inspeetiorvadministration of: <br />( I ) Santiago Park neighborhood improvements at up to three <br />locations on Edgewood andlor Bush Street to achieve traffic calming. Improvements may be based on input <br />from the Santiago Park Neighborhood Association and may include, but not be limited to, bulb -outs, traffic <br />circles and medians within the neighborhood streets. <br />(2) Street lighting enhaneements by replacing all existing non LED <br />light and/or fixture with LED light and or fixture throughout the Santiago Park Neighborhood. <br />(3) A street light at the Santiago park Drive/ Main Street intersection. <br />(4) Decorative concrete pavement within the intersection of Main <br />Street/Walkie Way and Main StreevSantiago park Drive. <br />422 Reserved. <br />4.2.3 Graffiti Removal. OWNER shall also install and maintain graffiti <br />protection on new surfaces and shall, within 24 hours of discovery of graffiti, cause it to be <br />removed and associated restorations completed throughout the Projeet. <br />4.3 Development Impact Fees. <br />4.3.1 Amount of Fee. The Development Impact Fees set forth in Exhibit <br />"D" shall be charged to the Projeet. These fee amounts are estimated and will be subject to <br />change based on the fee rate applicable at the time of issuance of the Building Pennit. <br />4.3 2 Time of Payment. The fees required pursuant to Subsection 4.3.1 shall <br />be paid to CITY prior to the issuance of building pennits for each residential unit. No fees <br />shall be payable for building pennits issued prior to the Effective Date of this Agreement, but <br />the fees required pursuant to Subsection 4.3.1 shall be paid prior to the re -issuance or extension <br />of any building pennit for a residential unit for which such fees have not previously been paid. <br />-15- <br />5539b,IM1o0_ 31553197.13 <br />
