CA-2019-226 <br />Cr COUNCIL <br />THIS FIRST AMENDMENT to the above -referenced agreement is entered into on November 19, <br />2019, by and between Siemens Industry, Inc. ("Consultant"), and the City of Santa Ana, a charter <br />city and immicipal corporation organized and existing under the Constitution and laws of the State <br />of California ("City"). <br />A. The patties entered into Agreement No. A-2015-078, dated May 5, 2015, by which <br />Consultant agreed to provide HVAC and lighting controls technical support and <br />maintenance services ("Agreement"). <br />B. The original term of the Agreement was for three years, with provision for extension, and <br />the term has been extended for the final one-year period ending April 30, 2020. <br />C. The patties now wish to amend the Agreement to finther extend the term of the Agreement <br />and to increase the amount to be expended during the final extension period. <br />The Parties therefore agree: <br />1. Section 3, Term, is amended to further extend the term of the Agreement through June 30, <br />2020. <br />2. Section 2, Compensation, is amended to increase the not -to -exceed expenditure by $105,000 <br />during the extended term ending on June 30, 2020. This sum is comprised of (1) $52,420 for <br />routine maintenance services and (2) $52,580 for additional services on an as -needed basis at <br />the sole discretion of the City. <br />3.
