<br />Resolution No. 2019-xx <br />Page 5 of 10 <br /> <br /> <br /> <br />WHEREAS, the proposed Project will not adversely affect the General Plan, as <br />amended by General Plan Amendment No. 2018-06, as is expressly set forth in the <br />Request for Planning Commission Action dated October 28, 2019, together with all <br />supporting documents, including but not limited to, proposed resolutions, which are <br />incorporated herein by this reference. <br /> <br />NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA DOES RESOLVE, DETERMINE, FIND AND ORDER AS FOLLOWS: <br /> <br />SECTION 1. CALIFORNIA ENVIRONMENTAL QUALITY ACT: In accordance <br />with the California Environmental Quality Act, the following environmental documents <br />have been prepared and made available to the public: Draft and Final Environmental <br />Impact Report No. 2018-01 for the Magnolia at the Park Multi-Family Residential <br />Project, Clarification to the 2525 N. Main Street Multi-Family Residential Project Final <br />Environmental Impact Report (Clarification), Mitigation Monitoring and Reporting <br />Program (MMRP) and Statement of Overriding Considerations and Findings of Fact. <br />The Planning Commission has reviewed and considered the information contained in <br />these documents and the administrative record for the Project, including all oral and <br />written comments received during the comment period. Based on the foregoing, the <br />Planning Commission recommends that the City Council find that the EIR, including the <br />Clarifications thereto, contain a complete and accurate reporting of the environmental <br />impacts associated with the Project, has been completed in compliance with CEQA, and <br />reflects the independent judgment of the City. The Planning Commission further <br />recommends that no evidence of new significant impacts or any new information of <br />“substantial importance” as defined by State CEQA Guidelines section 15088.5, has <br />been received by the City after circulation of the Draft EIR that would require <br />recirculation of the EIR. <br /> <br />The Planning Commission recommends that the City Council adopt the Findings of <br />Fact, certify the EIR, adopt the Statement of Overriding Considerations, and adopt the <br />MMRP. Any project approvals issued by the Planning Commission in this Resolution <br />shall not become effective unless and until the City Council has completed the actions <br />described above. <br /> <br />SECTION 2. GENERAL PLAN CONSISTENCY. Pursuant to California <br />Government Code section 65867.5(b) and based on the entire record before the <br />Planning Commission, including all written and oral evidence presented to the Planning <br />Commission, the Planning Commission hereby finds that the Development Agreement <br />is compatible with the objectives, policies, and general plan land use programs specified <br />in the General Plan for the City of Santa Ana in that: <br /> <br />A.
