<br /> <br />Resolution No. 2019-xx <br />Page 2 of 10 <br /> <br />WHEREAS, Environmental Impact Report No. 2018-01 analyzed the impacts <br />related to the proposed amendment to the General Plan Land Use Element; and <br /> <br />WHEREAS, on February 2, 2018, the City invited recognized Native American <br />tribes to engage in consultation regarding the proposed General Plan Amendment <br />pursuant to Government Code Section 65352.3; and <br /> <br />WHEREAS, on February 8, 2018, the City received a request for consultation <br />from the Gabrieleno Band of Mission Indians-Kizh Nation and a conference call <br />between the City and Chairman Salas occurred on March 15, 2018 during which the <br />history of uses and development of the Project Site and the depth of previous and <br />existing infrastructure on the site was discussed and Chairman Salas requested <br />additional information. On March 21, 2018 the City sent the requested information to <br />Chairman Salas. Chairman Salas did not respond to the City with any information or <br />evidence pertaining to Tribal Cultural Resources; and <br /> <br />WHEREAS, on July 12, 2018, the Applicant submitted a plan for a 496-units (84 <br />dwelling units per acre), with 908 parking spaces (1.83 parking spaces per unit) within a <br />5-story residential building with mezzanines wrapped around an eight-level parking <br />structure, tiered the height of the residential buildings along the east property line from <br />two, to three to four to five-stories and revised the unit mix to 73 studios, 307 one <br />bedrooms, 88 two bedrooms, and 28 three bedrooms; and <br /> <br />WHEREAS, consistent with State CEQA Guidelines section 15087(e), <br />Environmental Impact Report No. 2018-01 (State Clearinghouse No. 2018021031) for <br />the proposed Project was circulated for a 45-day review period beginning August 7, <br />2018 and ending September 21, 2018; and <br /> <br />WHEREAS, on August 27, 2018, the Planning Commission conducted a work <br />study session to overview the Project and thirty-two (32) verbal comments were <br />received, with three (3) in support and twenty-nine (29) in opposition; and nine (9) <br />written comments were received with one (1) in support and eight (8) in opposition; and <br /> <br />WHEREAS, in response to a request from Chatten-Brown & Cartens LLP, on <br />behalf of the North Santa Ana Preservation Alliance, the City extended the Draft <br />Environmental Impact Report public review and comment period to October 4, 2018 to <br />allow additional time for public review and input; and <br /> <br />WHEREAS, the Draft EIR was circulated for a 59-day review period, from August <br />7, 2018 to October 4, 2018; and <br /> <br />WHEREAS, on November 26, 2018, the Planning Commission continued a <br />duly noticed public hearing for the project to January 14, 2019. A second study <br />session was held to overview the Project and fifty-eight (58) verbal comments were <br />received with twenty-five (25) in support; thirty-one (31) in opposition and two (2) <br />neutral; and eleven (11) written comments were received with two (2) in support and <br />nine (9) in opposition; and <br />2-618
