<br /> <br /> <br />Resolution No. 2019-xx <br />Page 4 of 12 <br /> <br />the Project’s height, increased the Project’s setbacks, and modified the Project entrance <br />(“Modified Project”); and <br /> <br />WHEREAS, October 18, 2019, the City gave public notice of a Planning <br />Commission public hearing for consideration of Amendment Application No. 2018-10 by <br />advertising in the Orange County Register, a newspaper of general circulation, and on <br />October 17, 2019 by mailing to owners of property and residents within 500 feet of the <br />Project and posting on the project site; and <br /> <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />occurred. <br />NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA DOES RESOLVE, DETERMINE, FIND, AND ORDER AS FOLLOWS: <br />SECTION 1. CALIFORNIA ENVIRONMENTAL QUALITY ACT: In accordance <br />with the California Environmental Quality Act, the following environmental documents <br />have been prepared and made available to the public: Draft and Final Environmental <br />Impact Report No. 2018-01 the Multi-Family Residential Project, Clarification to the <br />2525 N. Main Street (Magnolia at the Park) Multi-Family Residential Project Final <br />Environmental Impact Report (Clarification), Mitigation Monitoring and Reporting <br />Program (MMRP) and Statement of Overriding Considerations and Findings of Fact. <br />The Planning Commission has reviewed and considered the information contained in <br />these documents and the administrative record for the Project, including all oral and <br />written comments received during the comment period. Based on the foregoing, the <br />Planning Commission recommends that the City Council find that the EIR, including <br />the Clarifications thereto, contain a complete and accurate reporting of the <br />environmental impacts associated with the Project, has been completed in <br />compliance with CEQA, and reflects the independent judgment of the City. The <br />Planning Commission further recommends that no evidence of new significant <br />impacts or any new information of “substantial importance”, as defined by State <br />CEQA Guidelines section 15088.5, has been received by the City after circulation of <br />the Draft EIR that would require recirculation of the EIR. <br /> <br />The Planning Commission recommends that the City Council adopt the Findings of <br />Fact, certify the EIR, adopt the Statement of Overriding Considerations, and adopt <br />the MMRP. Any project approvals issued by the Planning Commission in this <br />Resolution shall not become effective unless and until the City Council has <br />completed the actions described above. <br /> <br />SECTION 2. AMENDMENT APPLICATION: The Amendment Application <br />consists of amendments to the zoning map (SDM 6-5-9) and adoption of Specific <br />Development No. 93, as shown in Exhibit A and Exhibit B respectively, attached <br />hereto and incorporated herein by reference. <br /> <br />SECTION 3. LOCATION OF DOCUMENTS: The Amendment Application, <br />Environmental Impact Report and all supporting documents are on file and available <br />2-646
