INSURANCE ON FILE <br />vvw MAY PROCEED <br />UNTILINSURANCE EXPIRES <br />^D / O •-020,2 (� <br />!- CLERK OF COUr��� 1 9 2020 <br />er ' DATE: <br />A-2020-093-01 <br />Q ; CA At (09 FIRST AMENDMENT TO CONSULTANT AGREEMENT <br />THIS - FIRST AMENDMENT TO CONSULTANT AGREEMENT is made and entered <br />/ <br />into this I r: day of June, 2020, by and between Santa Ana Security Services Inc., a California <br />corporation ("Consultant"), and the City of Santa Ana, a charter city and municipal corporation <br />organized and existing under the Constitution and laws of the State of California ("City"). <br />RECITALS <br />A. City and Consultant entered into a Consultant Agreement dated April 29, 2020, <br />Agreement # A-2020-093, to provide security services for the COVID-19 trailers <br />at The Link ("said Agreement"). <br />B. City is the recipient of Homeless Housing, Assistance and Prevention Program <br />("HHAP-COVID") funds from the State of California. In 2020, Contractor <br />entered into Agreement Number 20-HCFC-00019 with the State of California <br />receiving and recognizing $1,385,224.15 in HHAP-COVID grant funds to be used <br />by Contractor to invest in COVID-19 prevention and containment efforts for <br />temporary shelters, including but not limited to medically indicated services and <br />supplies, such as testing and handwashing stations, and enhancements to existing <br />shelter facilities ("State HHAP-COVID Agreement"). A true and correct copy of <br />the State HHAP-COVID Agreement is attached hereto as Exhibit I and <br />incorporated herein by this reference. <br />C. < Consultant has been made aware of the State HHAP-COVID Agreement and <br />agrees to comply with all the conditions of the State HHAP-COVID Agreement <br />and the applicable State requirements governing the use of HHAP-COVID grant <br />funds. <br />D. In accordance with the terms and conditions of said Agreement, the Parties desire <br />to amend Section 2 — Compensation, to increase the maximum amount of <br />Compensation for said Agreement, Section 3 — Term, to extend the length of said <br />Agreement, and Section 10—Non-Discrimination, to comply with HHAP-COVID <br />funding requirements. Additionally, the Parties desire to add a new section <br />regarding the State HHAP-COVID Agreement funding requirements. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions of said Agreement, except as herein modified, the parties agree as follows: <br />Section 2, Compensation, shall be amended to increase the maximum amount of <br />compensation by eighty-six thousand dollars ($86,000.00) such that the total sum <br />to be expended under said Agreement shall not exceed one -hundred and eighty- <br />six thousand dollars:($186,000.00) during the term of said Agreement. <br />2. Section 3, Term, shall be amended to extend the Term of the Agreement from <br />July 29, 2020, through December 31, 2020. <br />Page 1 of 5 <br />
