SUB -RECIPIENT shall comply with the Federal Clean Water Act <br />(CWA) (33 U.S.0 §1251 et seq.), which establishes the basic <br />structure for regulating discharges of pollutants into the waters of the <br />United States and regulating quality standards for surface waters. <br />SUB -RECIPIENT shall comply with Federal Clean Air Act of 1955 (42 <br />U.S.C. § 7401) which regulates air emissions from stationary and <br />mobile sources. <br />SUB -RECIPIENT shall ensure that the facilities under its ownership, <br />lease or supervision which shall be utilized in the accomplishment of <br />this project are not listed in the Environmental Protection Agency's <br />(EPA) list of Violating Facilities and that it will notify the Federal <br />Grantor agency of the receipt of any communication from the <br />Director of the EPA Office of Federal Activities indicating that a <br />facility to be used in the project is under consideration for listing by <br />the EPA. <br />SUB -RECIPIENT shall comply with the Energy Policy and <br />Conservation Act (P.L. 94-163, 89 Stat. 871). <br />SUB -RECIPIENT shall not be: (1) in violation of any order or <br />resolution promulgated by the State Air Resources Board or an air <br />pollution district; (2) subject to a cease and desist order pursuant to § <br />13301 of the California Water Code for violation of waste discharge <br />requirements or discharge prohibitions; or (3) determined to be in <br />violation of federal law relating to air or water pollution. <br />By signing this Agreement, SUB -RECIPIENT ensures that it is in <br />compliance with the California Environmental Quality Act (CEQA), <br />Public Resources Code §21000, et seq., CEQA Guidelines <br />(California Code of Regulations, Title 14 Division 6, Chapter 3, §§ <br />15000-15387), and is not impacting the environment negatively. <br />11. Preservation <br />SUB -RECIPIENT shall comply with Section 106 of the National <br />Historic Preservation Act of 1966, as amended (16 U.S.C. §470), EO <br />11593 (identification and protection of historic properties), and the <br />Archaeological and Historic Preservation Act of 1974 (16 U.S.C. <br />§§469a-1, et seq.). <br />12. Suspension and Debarment <br />SUB -RECIPIENT shall comply with Federal Register, Volume 68, <br />Number 228, regarding Suspension and Debarment, and SUB - <br />RECIPIENT shall submit a Certification Regarding Debarment required <br />by Executive Order 12649 and any amendment thereto. Said <br />Certification shall be submitted to the CITY concurrent with the <br />execution of this Agreement and shall certify that neither SUB- <br />19 <br />
