SUB -RECIPIENT hereby certifies that it will comply with the <br />Americans with Disabilities Act, 42 USC §§ 12101, et seq., and its <br />implementing regulations. SUB -RECIPIENT will provide reasonable <br />accommodations to allow qualified individuals with disabilities to <br />have access to and to participate in its programs, services and <br />activities in accordance with the provisions of the Americans with <br />Disabilities Act. SUB -RECIPIENT will not discriminate against <br />persons with disabilities or against persons due to their relationship <br />to or association with a person with a disability. Any subcontract <br />entered into by the SUB -RECIPIENT, relating to this Agreement, to <br />the extent allowed hereunder, shall be subject to the provisions of <br />this paragraph. <br />4. Political and Sectarian Activity Prohibited <br />None of the funds, materials, property or services provided directly or <br />indirectly under this Agreement shall be used for any partisan political <br />activity, or to further the election or defeat of any candidate for public <br />office. Neither shall any funds provided under this Agreement be <br />used for any purpose designed to support or defeat any pending <br />legislation or administrative regulation. None of the funds provided <br />pursuant to this Agreement shall be used for any sectarian purpose or <br />to support or benefit any sectarian activity. <br />If this Agreement provides for more than $100,000 in grant funds or <br />more than $150,000 in loan funds, SUB -RECIPIENT shall submit to <br />the CITY a Certification Regarding Lobbying and a Disclosure Form, <br />if required, in accordance with 31 USC §1352. A copy of the <br />Certificate is attached hereto as Exhibit B. No funds will be released <br />to SUB -RECIPIENT until the Certification is filed. <br />SUB -RECIPIENT shall file a Disclosure Form at the end of each <br />calendar quarter in which there occurs any event requiring disclosure <br />or which materially affects the accuracy of any of the information <br />contained in any Disclosure Form previously filed by SUB - <br />RECIPIENT. SUB -RECIPIENT shall require that the language of this <br />Certification be included in the award documents for all sub -awards <br />at all tiers and that all subcontractors shall certify and disclose <br />accordingly. <br />5. Records Inspection <br />In accordance with 2 CFR §200.336,at any time during normal <br />business hours and as often as the CITY, the U.S. Comptroller <br />General, and/or the Auditor General of the State of California may <br />deem necessary, SUB -RECIPIENT shall make available for <br />examination all of its records with respect to all matters covered by <br />this Agreement. The CITY, the U.S. Comptroller General and/or the <br />Auditor General of the State of California shall have the authority to <br />audit, examine and make excerpts or transcripts from records, <br />15 <br />
