2.3.3 The Santa Ana Municipal Code Section 41-2011(a) Lined Block Building <br />Type 10-story maximum development standard for this Project shall be waived in accordance with <br />Government Code Section 65915(e)(1), as such sixteen stories shall be a permitted for the Project. <br />2.3.4 The Santa Ana Municipal Code Section 41-2023(f) Open Space <br />development standard for this Project shall be modified in accordance with Government Code <br />Section 65915(d)(1), as such the common open space shall be provided as roof decks on various <br />building levels for the Project. <br />2.3.5 The Santa Ana Municipal Code Section 4t-2023(i) Massing development <br />standard for this Project shall be modified in accordance with Government Code Section <br />65915(d)(1), as such the massing ratio for level three shall be permitted at 94 percent for the <br />Project. <br />2A No Further Concessions Incentives or Waivers. Developer acknowledges and <br />agrees that the concessions, incentives, and waivers set forth in section 2.3 above fully satisfies <br />any duty City may have under the Santa Ana Municipal Code, the Density Bonus Law, or any <br />other law or regulation to provide any development incentive or to waive any building, zoning, or <br />other requirement in return for providing Affordable Units. By this Agreement, Developer releases <br />any and all claims Developer may have against City in any way relating to or arising from City's <br />obligation to waive requirements of or provide development incentives pursuant to any state, <br />federal, or local law, rule, or regulation applicable to the Project. <br />2.5 Unrestricted Units, The Project, for purposes of this Agreement, may have no more <br />than one -hundred and fifty-two (I52) Unrestricted Units comprised of eighty-five (95) studio units, <br />forty-five (45) one -bedroom units and twenty-two (22) two -bedroom units. Any change to the unit <br />distribution of the Unrestricted Units may affect the comparability of the Affordable Units and is <br />subject to City Manager approval. <br />2.6 Affordable Units. The Project, for purposes of this Agreement, shall have no less <br />than nineteen (19) Units, which shall be comprised of ten (10) studio units, six (6) one -bedroom <br />units, and three (3) two -bedroom units, designated as Affordable Units pursuant to the terms and <br />conditions of this Agreement. The Affordable Units shall be consistent with all City approvals, <br />comparable in bedroom distribution and amenities to the Unrestricted Units, and shall be located <br />throughout the Project as required under Santa Ana Municipal Code section 41-1602(c)(6). <br />2.7 Minimum Development Standards for Affordable Units. The Affordable Units <br />shall be constructed with the same exterior appearance and interior fcawres, fixtures, and <br />amenities, and shall use the same type and quality of materials as provided for any Unrestricted <br />Units. <br />IS Permits and Processing; Compliance with Laws. Developer, at its sole cost and <br />expense, shall secure or cause to be secured any and all permits that may be required by City or <br />any other federal, state, or local governmental entity having or claiming jurisdiction over the <br />Property or Project. Upon securing any and all permits, Developer shall carry out and perform the <br />development, operation, and maintenance of the Project in conformity with all applicable federal, <br />75A-141 <br />
