There are no substantial changes in <br />the circumstances, or new information that would require the preparation of a subsequent EIR. <br />0-25 The Certified EIR includes all feasible mitigation necessary to mitigate the potential impacts related <br />to implementation of the Transit Zoning Code. These mitigation measures have been incorporated <br />into the Addendum. During the environmental processing of Certified EIR, no comments were <br />received on the mitigation measures and no challenge to the Certified EIR was filed. Since this issue <br />was not raised during the public comment period or at the hearings for the Certified EIR, there is no <br />longer standing to litigate this issue under CEQA. <br />0-26 This comment is noted, and no response is required. <br />0-27 The Commenter asserts that the Proposed Project requires an Environmental Impact Report. The <br />City of Santa Ana prepared an EIRAddendum consistentwith Sections 15161 and 15164of the CEQA <br />Guidelines to determine if there were any new significant impacts associated with the Proposed <br />Project that were not previously addressed in the Transit Zoning Code EIR. As discussed throughout <br />the Addendum, the Proposed Project does not meet the criteria identified in Section 15162 of the <br />State CEQA Guidelines requiring preparation of a subsequent or supplemental EIR. Additionally, as <br />shown in responses 0-1 through 0-23, the Proposed Project has been adequately analyzed in the <br />Addendum. As a result, no additional CEQA analysis is necessary for the Proposed Project.
