SPECIAL PROPERTY COVERAGE FORM <br />remediation of property due to <br />contamination by "pollutants and <br />contaminants" or due to the <br />presence, growth, proliferation, <br />spread of any activity of "fungi", <br />wet or dry rot, bacteria or virus; or <br />(b) The costs associated with the <br />enforcement of any ordinance or <br />law which requires any insured or <br />others to test for, monitor, clean <br />up, remove, contain, treat, detoxify <br />or neutralize, or in any way <br />respond to, or assess the effects <br />of "pollutants or contaminants", <br />"fungi", wet or dry rot, bacteria or <br />virus. <br />(c) Loss caused by, resulting from, <br />contributed to or aggravated by <br />earthquake or volcanic eruption. <br />(d) Loss due to an ordinance or law <br />that: <br />(i) You were required to comply <br />with before the loss even if the <br />building was undamaged; and <br />(ii) You failed to comply with. <br />(3) Additional Limitations — Loss to <br />Undamaged Portion of Building <br />Subject to the limit stated in Paragraph <br />A.5.j.(1)(a), the insurance provided <br />under this Additional Coverage for loss <br />in value to the undamaged portion of <br />the building is limited as follows: <br />(a) If Replacement Cost applies and <br />the property is repaired or <br />replaced on the same or another <br />premises, we will not pay more for <br />physical loss of or physical <br />damage to designated Building <br />property, including loss caused by <br />enforcement of an ordinance or <br />law, than: <br />(i) The amount you actually spend <br />to repair, rebuild or reconstruct <br />the Building, but not for more <br />than the amount it would cost to <br />restore the Building on the same <br />premises; and <br />(ii) The amount it would cost to <br />restore the undamaged portion <br />to the same height, floor area, <br />style and comparable quality of <br />the original property insured. <br />Page 8 of 25 <br />(b) If the Building(s) Full Value <br />Endorsement applies and the <br />property is repaired or replaced on <br />the same or another premises, we <br />will not pay more for physical loss of <br />or physical damage to designated <br />Building property, including loss <br />caused by enforcement of an <br />ordinance or law, than: <br />(i) The amount you actually spend <br />to repair, rebuild or reconstruct <br />the Building, but not for more <br />than the amount it would cost to <br />restore the Building on the same <br />premises; and <br />(ii) The amount it would cost to <br />restore the undamaged portion <br />to the same height, floor area, <br />style and comparable quality of <br />the original property insured. <br />(c) If Replacement Cost or the <br />Building(s) Full Value <br />Endorsement applies and the <br />property is not repaired or <br />replaced, or if Actual Cash Value <br />applies, then we will not pay more <br />for physical loss of or physical <br />damage to designated Building <br />property, including loss caused by <br />enforcement of an ordinance or <br />law, than the lesser of: <br />(i) The Actual Cash Value of the <br />Building at the time of loss; or <br />(ii) The Limit of Insurance <br />applicable to the covered <br />Building property stated in <br />Paragraph A.5.j.(1)(a). <br />(4) Additional Limitation — Demolition <br />Cost <br />We will not pay more than the lesser <br />of: <br />(a) The amount actually spent to <br />demolish and clear the site of the <br />"scheduled premises"; or <br />(b) The applicable Demolition Cost <br />Limit of Insurance as stated in <br />Paragraph A.5.j.(1)(b). <br />(5) Additional Limitation — Increased <br />Cost of Construction <br />The insurance provided under this <br />Additional Coverage for increased cost <br />of construction is limited as follows: <br />(a) We will no <br />cF RAMmWmentDMsian <br />Jy/ \'x REVIEWED & APPROVED BY: <br />V"° <br />--� Risk Pjanagement Analyst <br />
