REQUEST FOR <br />COUNCIL ACTION <br />PREPARED BY <br />Robert Nichols, Jr. <br />June 29, 1977 <br />DATE PHONE <br />SUBJECT <br />4926 <br />EXCHANGE OF CITY -OWNED SURPLUS LAND <br />PARCEL, NORTHWEST CORNER FIRST AND <br />BRISTOL STREETS <br />DEPUTY CITY MANAGER <br />RECOMMENDED ACTION <br />DATE OF • ACTION <br />`IP IIIIIIIII <br />C ITV MANAGIM C�LE RRK=HE CDUMM <br />It is recommended that Council authorize the disposal of the surplus land parcel located <br />at the northwest corner of First and Bristol Streets by exchange as proposed herein, and <br />direct the Mayor to execute all necessary documents for the transfer between the City of <br />Santa Ana and the African Methodist Episcopal Church. <br />BACKGROUND <br />The present City -owned land parcel situated at the northwest corner of First and Bristol <br />Streets consists of the remainders of six building lots which were purchased by the City <br />as full takings during 1967-68 in conjunction with the widening of First Street. The <br />parcel was certified as surplus to the City's needs in 1968 by SPR #28-68. <br />Recently the owners of contiguous property, the African Methodist Episcopal Church, have <br />approached the City with a proposal to acquire the surplus parcel. Their need for the <br />parcel is to expand their present holding to provide for relocation of their church <br />building from its present site at the northwest corner of Second and Bristol Streets, as <br />this present site creates a building encroachment into the right of way for proposed Bristol <br />Street widening. <br />ANALYSIS <br />An appraisal was secured on the portion of the Church's present site to be acquired for <br />the Bristol Street widening, including the cost of relocating the Church back out of the <br />proposed right of way. The amount of consideration to be paid by the City for this acquisition <br />was $30,978. An appraisal was also secured on an intervening lot, situated on the south- <br />west corner of Second and Bristol Streets, a portion of which is also to be needed for the <br />Bristol Street widening. The Church also desired to purchase the remainder of this lot at <br />such time as the City acquired it and completed the proposed widening operation. The present <br />value of the remainder portion of this lot was appraised at $9,114. A concurrent appraisal <br />of the City's surplus parcel indicated its current value to be $67,000. <br />The Church agreed to purchase the City's surplus parcel for its previously -appraised value of <br />$80,000 and to purchase the surplus portion of the contiguous lot at its full appraised value <br />of $9,114. As a down payment, credit would be allowed by the City in the amount of compensa- <br />tion due the Church, or $30,978, with the balance to be financed by note and trust deed in <br />accordance with terms specified in Section 2.706.2 of the City Code and authorized as a <br />property exchange by Section 2.710 of the Code. <br />This proposed exchange transaction at this time is at the specific request of the Church. <br />It is in the best interests of the City and can be expected to effect a material saving <br />over a future standard right of way purchase, plus affording an adequate site for the <br />relocation of the Church building as an alternative to the necessity of cutting and <br />refacing it if left in its present location. <br />Funding for the proposed exchange transaction, which would presently be limited to miscel- <br />laneous overhead and transfer expenses, is available from the Gas Tax Contingency fund. <br />It is estimated that all such expenses would not exceed the amount of $2,000. <br />12C <br />
