<br />B. The following exclusion is hereby added to of any "NBC material" as a direct or
<br />paragraph 2., Exclusions of SECTION I. indirect result of any actual, attempted,

<br />Nuclear, Biological, or Chemical
<br />Notwithstanding any other provision of
<br />this policy, this insurance does not apply
<br />to any "personal or advertising injury"
<br />caused, directly or indirectly, in whole or
<br />in part, by any of the following, regardless
<br />of any other cause(s) or event(s) that may
<br />contribute concurrently or in any other
<br />sequence to the "personal and advertising
<br />injury":
<br />(1) Any actual, attempted, suspected, or
<br />threatened use of any "NBC material"
<br />as part of any plan, effort, or design,
<br />actually or apparently intended to
<br />cause any:
<br />(a) loss or damage to any tangible or
<br />intangible property, or
<br />(b) "bodily injury" or emotional dis-
<br />tress.
<br />(2) Any actual, attempted, suspected, or
<br />threatened presence, spread, dissemi-
<br />nation, release, escape, or distribution
<br />(a) loss or damage to any tangible or
<br />intangible property, or
<br />(b) "bodily injury" or emotional dis-
<br />tress.
<br />"NBC Material" means any nuclear, bio-
<br />logical, or chemical material or substance
<br />that causes damage to property or is
<br />harmful to human health. "NBC material"
<br />includes, but is not limited to:
<br />(1) any radioactive substance or material,
<br />and the radiation it releases,
<br />(2) any pathogen, bacterium, microbe,
<br />virus, or other organism,
<br />(3) any substance or material produced by
<br />or from any pathogen, bacterium, mi-
<br />crobe, virus, or other organism, and
<br />(4) any poison, toxin, or other harmful
<br />chemical, substance, or material.
<br />The foregoing list (1) through (4) is only
<br />illustrative, and should not be construed as
<br />a complete, exclusive, or exhaustive list of
<br />all "NBC materials."
<br />This endorsement does not change any other provision of the policy.
