Representations <br />By accepting this Policy, you agree: <br />a. the statements in the Abuse and Molesta- <br />tion Application are accurate and com- <br />plete; <br />b. those statements are representations you <br />made to us; and <br />c. we have issued this Policy in reliance upon <br />your representations. <br />6. Separation of Insureds <br />Except with respect to the Limit of Insurance, <br />and any rights or duties specifically assigned <br />in this Coverage Part to the first Named In- <br />sured, this insurance applies: <br />a. as if each named insured were the only <br />Named Insured; and <br />b. separately to each insured against whom <br />claim is made or "suit' is brought. <br />7. Transfer of Rights of Recovery Against <br />Others to Us <br />If the Insured has rights to recover all or part <br />of any payment we have made under this <br />Coverage Part, those rights are transferred to <br />us. The Insured must do nothing after loss to <br />impair them. At our request, the Insured will <br />bring "suit' or transfer those rights to us and <br />help us enforce them. <br />8. When We Do not Renew <br />If we decide not to renew this Coverage Part, <br />we will mail or deliver to the first Named <br />Insured shown in the Declarations written no- <br />tice of the nonrenewal not less than 30 days <br />before the expiration date. <br />If such notice is mailed, proof of mailing will <br />be sufficient proof of notice. <br />SECTION VI - DEFINITIONS <br />1. "Abuse" means: <br />a. any actual, threatened, or alleged act, er- <br />ror, omission, conduct, or misconduct, <br />that a claim or "suit' alleges to be, or to <br />constitute, any form of abuse (including, <br />but not limited to, elder abuse, child abuse, <br />patient abuse, or abuse of a dependent <br />person) under any applicable state or fed- <br />eral statute or regulation; and <br />b. any actual, threatened, or alleged act, er- <br />ror, omission, conduct, or misconduct, of <br />one or more of the following kinds: <br />CG 85 65 (Ed. 01/12) (Page 9 of 10) <br />(1) sexual behavior, sexual conduct or <br />misconduct, sexual assault, sexual bat- <br />tery, sexual abuse, or sexual molesta- <br />tion, of or directed at a person; <br />(2) non -sexual assault, non -sexual bat- <br />tery, or non -sexual abuse, of or di- <br />rected at a person; and <br />(3) any: <br />(i) employment; <br />(ii) investigation; <br />(iii) supervision; <br />(iv) reporting to proper authorities, or <br />failure to so report; or <br />(v) retention in employment; <br />of any person committing conduct or <br />misconduct described in b.(1) or b.(2); <br />or <br />(vi) referral of a patient, student, pa- <br />rishioner, client, or person, to any <br />other person whose conduct or <br />misconduct is described in a., <br />b.(1), or b.(2). <br />Conduct or misconduct described in b.(1) <br />through b.(3) constitutes "abuse" within the <br />meaning of this definition regardless of <br />whether or not it is alleged to be neg- <br />�oRaN <br />RiskMwaganedDMsian <br />REVIEWED & APPROVED BY. - <br />Risk Management Analyst <br />
