7. INSURANCE <br />Prior to undertaking performance n[work under this Agreement, Contractor shall maintain <br />and shall require its subcontractors, if any, to obtain and maintain insurance as described below: <br />Commercial General Liability Insurance. Contractor shall maintain commercial <br />cencm| liability insurance narning the City, its uffiuco, employees, agents, <br />volunteers and representatives as additional inoured(s)and shall include, but not hc <br />limited to protection against u|oimx mioioQ from bodily and personal injury, <br />including death resulting therefrom and damage 0oproperty, resulting from any act <br />or occurrence arising out of Contractor's operations in the pudhononcn of this <br />A8ncemcrk, including, without limitation, acts involving vehicles. The amounts of <br />insurance shall honot less than the following: oiug|c limit coverage applying m <br />bodily and po,mouu| injury, including death resulting therefrom, and property <br />damage, inthe total amount of$),0U0,0O0per occurrence, with $2'OOO,000iuthe <br />aggregate. Such insurance shall (a)name the City, its officers, employees, agents, <br />and representatives as additional iomu,ed(a); (h) he primary and not contributory <br />with respect to insurance or self-insurance programs maintained by the City; and <br />(o)contain standard separation ofinsureds provisions. <br />b. Business automobile liability insurance, coequivalent form, with ucombined single <br />limit of not less than $1l00,000 per occurrence. Such inoum000 xhu| include <br />coverage for owned, hired and non -owned uutomobi|ou. <br />C. Worker's Compensation Insurance. !naccordance with the provisions ufSection <br />3700ofthe Labor Code, Contractor, ifContractor has any employees, iorequired <br />W he insured against liability for worker's compensation or to undertake self- <br />insurance. Prior to commencing the performance of the work under this <br />Agreement, Contractor uAmua to obtain and maintain any employer's liability <br />insurance with limits not less than $},000,000per accident. <br />d. If Contractor is or employs a licensed professional such as an architect or engineer: <br />Professional liability (errors and omissions) insurance, with a combined single limit <br />ofnot less than $\,008,00Oper claim with $2,0U0,0OOinthe aggregate. <br />C. The following requirements apply to the iooumuoe to he provided by Contractor <br />pursuant tothis section: <br />i. Contractor ahu|| maintain all insurance required above in full tboe and <br />effect for the entire period covered 6ythis Agreement. <br />ii. CortifiouLco of insurance ohu|| he furnished to the City upon execution of <br />this Agreement and shall buapproved hythe City. <br />iii. Certificates and policies shall state that the policies shall not be canceled or <br />reduced in coverage or changed in any other material aspect without thirty <br />(}8)days prior written notice \nthe City, <br />iv. Where the amounts orcoverage provided bythe certificates ofinsurance <br />provides coverage greater than those listed by this Agreement, the amounts <br />provided bythe certificates ofinsurance shall hcincorporated byreference <br />into the Agreement. <br />V.
