EXHIBIT 2 <br />FIRST AMENDMENT TO <br />CONDITIONAL GRANT AGREEMENT <br />INCLITSIONARV HOUSING PROGRAM <br />'11115 I+'IRS'I' AY1b;NUMB;N'I"I'O CONDITIONAL GRANTAGRICEIYIENT <br />("First Aunendmenl") dated, for identification purposes only, as of April 6, 2021, is madc <br />and entered into by and between the City of Santa Ana, a charter city and municipal <br />corporation ("City"), and habitat for humanity of Orange County, a nonprofit organization <br />("Developer") with reference to the following: <br />RECITALS: <br />A. I'hc City and Developer executed a Conditional Grant Agreement <br />Tnclusionary Housing Program Baled November 17, 2020, in the amount of S231,494 <br />("Grant Agreement"), for the Proposed development of two (2) sin -lc -family detached <br />home restricted for ;ale to moderate income tamihes earning no more than 120'%o of the <br />Orange County Area Median Income ("Project") to be located at 416 Vance Street (AI'N 398- <br />041-18) and 826 N. Lacy Street (APN 398-041-220) (collectively, the "Property'). <br />R. Developer requested an additional $333,777 from the City in order to oll'wl <br />a portion of the additional construction costs associated with the Project Line to the <br />architectural requirements of French Park where the Property is located - <br />The City, on the same terms and conditions found in the Grant Agreement, <br />desires un increase such Conditional Tnclusionary Grant to Developer in order to make. <br />possible the development and construction of the Project, thereby expanding the ,apply of <br />deceit, sate, sanitary and at ordnblc housing within the City. <br />1). .I'his First Amendment is enlered into 1161- the purpose of increasing the lolal <br />amount of the Conditional Tnclusionary Grant fium the City un the Developer lirr <br />completion of the Project, pursuant to the Tnclusionary Housing Fond regulations and <br />guidelines. <br />NOW THERF.FORF, in consideration of the nunual and respectivepronrises, and subject <br />to the tct7rs and conditions ol'said Grant Agreement, except as herein modified, the panics <br />agree as follows: <br />Section 1 .1, Defined l erms, shall be amended to increase the total amount <br />in the definilion of "Tnclusionary Grant" or "hnclusionary City Grant" by <br />$333,777 for a total Tnclusionary Grant amount up to $565,271- <br />2. Section 3.1, lnclusionary Funds, shall be amended to increase the total <br />amount of the Tnclusionary Grant by $333,777 for a total Tnclusionary C rant <br />anuxmt up to $5(i5,271- <br />City Council 21 — 6 416/2021 <br />
