THE ORDINANCE ESTABLISHES THE SANTA ANA RENT BOARD, WHICH <br />HAS AN IMBALANCED COMPOSITION THAT FAILS THE TEST OF DUE <br />PROCESS OF LAW AND IS THEREFORE UNCONSTITUTIONAL <br />The proposed ordinance, at Section 12 (Santa Ana Rent Board) provides for an <br />imbalanced but interested composition which is a violation of due process of law. <br />The ordinance states as follows: <br />SECTION 12 Santa Ana Rent Board <br />(a) Composition. There shall be an appointed Santa Ana Rent Board <br />comprised of City residents as set forth in this Section. The Rent Board shall <br />consist of seven (7) members appointed by the City Council. Membership of the <br />Rent Board shall consist of at least four (4) members who are <br />Tenants/Mobilehome Owners/Residents as those terms are defined under this <br />Chapter; at least two (2) members of the community who neither own nor manage <br />a Rental Unit or Property as that term is defined under this Chapter; (1) member <br />who is either a Landlord or manages a Rental Unit or Property as that term <br />is defined under this Chapter, but no more than two (2) Landlords or <br />persons who manage a Rental Unit, Dwelling or Property, shall sit on the Rent <br />Board at any given time. The City Council shall take steps to ensure that the <br />makeup of the Rent reflects the population of the City of Santa Ana regarding <br />racial, gender, and socioeconomic diversity. <br />(Emphasis supplied). <br />is 1 California Environmental Law & Land Use Practice § 21.09 (2020) <br />—24— <br />
