1.24 Contractor's Proposal <br />"Contractor's Proposal" means the proposal submitted by Contractor to City on <br />September 15, 2020 in response to a Request for Proposals dated March 24, 2020, as <br />further negotiated by Contractor and City. Contractor's Proposal was selected by City <br />based on its competitive advantages over other proposals received, and City specifically <br />relied upon the representations and warranties set forth therein in entering into this <br />Agreement. Contractor's Proposal is incorporated into this Agreement by reference, <br />and Contractor represents and warrants that all representations set forth in such <br />proposal, as further negotiated by Contractor and City, are true and correct. <br />1.25 Contractor Compensation <br />"Contractor Compensation" means the revenue received by the Contractor from <br />Billings, excluding City fees as defined in Article 3 of this Agreement, in return for <br />providing services in accordance with this Agreement and any amendments to this <br />Agreement. <br />1.26 CPI <br />"CPI" means the Consumer Price Index ("CPP'), All Urban Consumers Less Food and <br />Energy - US City Average (CUUROOOOSAOLIE). <br />1.27 Customer <br />"Customer" means the Person having the care and control of any Premises in the City <br />receiving Solid Waste Handling Service from the Contractor pursuant to the terms of <br />this Agreement. <br />1.28 Designated Disposal Facility <br />Designed Disposal Facility" means the Orange County Landfill System operated by <br />Orange County Waste and Recycling. <br />1.29 Designated Waste <br />"Designated Waste" means non -Hazardous Waste which may pose special Disposal <br />problems because of its potential to contaminate the environment and which may be <br />Disposed of only in Class II Disposal sites or Class III Disposal sites pursuant to a <br />August 17, 2021 9 City of Santa Ana <br />
