If a Customer rejects the proposal from the Contractor or does not provide a response <br />within 30 days of the Contractor submitting the proposal, and, after at least three <br />documented attempts by the Contractor to follow-up with the Customer, the Customer <br />continues to be non -responsive, the Contractor may refer the Customers to the City for <br />enforcement action through any future ordinances that may be implemented by the <br />City. Such a referral to the City by the Contractor for non -compliant accounts must <br />include a written summary of the actions taken by the Contractor to implement an AB <br />1826/SB 1383-compliant program; a copy of the written proposal submitted to the <br />Customer by the Contractor; and any written correspondence from the Customer to the <br />Contractor. If, after the City begins enforcement proceedings against the Customer, the <br />Customer agrees to comply and implement an AB 1826/SB 1383-compliant program, <br />the City will notify the Contractor of the Customer's willingness to comply and the <br />Contractor will coordinate with the Customer to implement an AB 1826/SB 1383- <br />compliant program. <br />Contractor will incorporate education regarding Organics Recycling and the State <br />requirements into materials produced under Section 5.3, and will develop its own <br />Organics -specific instructional materials for use in educating participating Customers. <br />All participants shall receive ongoing, on -site training from Contractor for management, <br />kitchen staff, service employees, janitors, etc. Annually, Contractor will create and <br />distribute a letter to all Customers that are enrolled in the Contractor's Organics <br />Recycling program to offer re-training services, printed collateral such as signage and <br />posters, and general technical assistance. Additional materials may include <br />instructional posters, brochures, educational presentations, bin signage, enclosure <br />signage, stickers to be attached to internal Recycling receptacles, or other formats as <br />mutually agreed to between City and Contractor. Contractor will provide Customers <br />that enroll in the Contractor's Organics Recycling program with one (1), yellow, internal <br />Recycling receptacle upon request by the Customer at a price equal to Contractor's cost. <br />Contractor will track the distribution of the internal Recycling receptacles and provide <br />quarterly distribution data to the City. As with all outreach material, all items must be <br />submitted for review and approval by City prior to distribution. <br />Contractor shall provide a report, on City provided forms, to the City noting the time, <br />Customer contact, name of Contractor staff that contacted the Customer, and result of <br />each meeting and, if the Customer will not agree to a meeting, provide the time of <br />contact, Customer contact name and number, and reason for not accepting a meeting. <br />August 17, 2021 62 City of Santa Ana <br />
