H. Correction of Defects. Following any inspection, the Executive Director <br />shall have the right to cause Contractor, at its sole cost and expense, to recondition or <br />replace any vehicle or equipment found to be unsafe, unsanitary or unsightly. The <br />Executive Director's determination may be appealed to the City Council, whose <br />decision shall be final. <br />I. City Informational Displays. Contractor shall equip all vehicles which <br />Collect Solid Waste within the City with informational displays. The City shall advise <br />Contractor as to the messages which should be displayed while vehicles are operating <br />for the City. The City may, at its option, have the messages to be displayed changed <br />once per year at no additional cost. <br />4.7.4 Containers <br />4.7.4.1 Contractor -Provided Carts <br />A. Cart Selection, Distribution and Exchanges. Contractor shall provide <br />Customers with new Refuse, Recycling and Organics Carts at the start of service under <br />this Agreement, at no additional charge. <br />In advance of initial new Cart distribution, Contractor shall mail a notice of rates, and <br />provide Customers the opportunity to request service changes. If no response is <br />received by Customer by specified date, Customer will retain the same level of service <br />currently provided as reported by the previous waste hauler. <br />B. Cart Design Requirements. The Carts shall be manufactured by injection <br />or rotational molding and meet the Cart design and performance requirements as <br />specified below. All Carts selected shall be subject to City approval. The City will not <br />permit Carts in poor condition to be used in the City at any time during the term of this <br />Agreement, and may require Contractor to replace such Carts. Contractor shall ensure <br />that all Carts in service during the terms of this Agreement comply with CalRecycle's <br />Cart lid color requirements under SB 1383. In the event that Cart bodies are not the <br />same color as Cart lids, Cart bodies must be one consistent color for all waste streams. <br />August 17, 2021 73 City of Santa Ana <br />
