Other items not specifically included or excluded above <br />will be Collected provided that they are not more than eight feet in length, four feet in <br />width, or more than 150 pounds. In the event a question ever arises as to whether a <br />specific item or category of items meets the definition of Bulky Items, City shall be <br />responsible to determine whether said definition shall apply, which determination shall <br />be final and binding on the Parties. <br />1.14 CalRecycle <br />"CalRecycle" means the State of California's Department of Resources Recycling and <br />Recovery, and, as this department was structured prior to January 1, 2010, the <br />California Integrated Waste Management Board or CIWMB, as well as any successor <br />agency to CalRecycle. <br />1.15 Cart <br />"Cart" means a plastic Container with a hinged lid and wheels serviced by an <br />automated or semi -automated truck with a capacity of no less than 30 and no greater <br />than 101 gallons. <br />1.16 City <br />"City" means City of Santa Ana, California, a municipal corporation, and all the <br />territory lying within the municipal boundaries of City as presently existing or as such <br />boundaries may be modified during the term of this Agreement. <br />1.17 Collect/Collection <br />"Collect" or "Collection" means to take physical possession, transport, and remove Solid <br />Waste within and from City. <br />1.18 Commercial <br />"Commercial" refers to services performed at or for Commercial Premises. <br />1.19 Commercial Edible Food Generators <br />"Commercial Edible Food Generators" includes Tier One Commercial Edible Food <br />Generators and Tier Two Commercial Edible Food Generators, or as otherwise defined <br />in 14 CCR Section 18982(a) (7).
