compliance with the requirements of Section 4.9 of this Agreement and this Exhibit <br />unless City waives one or more requirements. <br />I. Monitoring, Waste Evaluations, and Capacity Planning Requirements. Contractor shall <br />conduct material sampling, sorting, and waste evaluations of various material streams <br />as further described in Section 8.5 in this Exhibit 8 to meet or exceed SB 1383 <br />requirements. Upon City request, the Contractor shall also participate in facility <br />capacity planning studies to ensure that sufficient capacity is allocated to the City. <br />J. Compliance with Applicable Law. Contractor (including its Affiliates and <br />Subcontractors) warrants throughout the Term of this Agreement and any extensions <br />that the Approved Facilities are respectively authorized and permitted to accept <br />Recyclable Materials, Organic Materials, and C&D Debris m accordance with <br />Applicable Law and are in full compliance with Applicable Law. <br />K. Records and Investigations. Contractor shall maintain accurate records of the quantities <br />of Discard Materials Transported to and accepted at the Approved Facility(ies) and <br />shall cooperate with City and any regulatory authority in any audits or investigations of <br />such quantities. <br />L. Inspection and Investigations. An authorized City employee or agent shall be allowed <br />to enter each Facility during normal working hours in order to conduct inspections and <br />investigations in order to examine Facility operations; Processing activities; <br />contamination monitoring; material sampling and sorting activities, including <br />inspection of end -of -line materials after sorting; and records pertaining to the Facility in <br />order to determine compliance with Applicable Law, including SB 1383, to understand <br />protocols and results, and conduct investigations, if needed. Contractor shall permit <br />City or its agent to review or copy, or both, any paper, electronic, or other records <br />required by City. <br />8.2. Processing Standards <br />A. Recovery Required. Contractor agrees to Transport and deliver all Source Separated <br />Recyclable Materials, Source Separated Organic Materials, and C&D Debris Collected <br />under this Agreement to the Approved Facility for Processing as applicable for each <br />material type. Contractor shall conduct Processing activities for all Source Separated <br />Recyclable Materials, Source Separated Organic Materials, and C&D Debris to recover <br />Recyclable Materials and Organic Waste to reduce Disposal.
