Housing Opportunity Ordinance <br />September 7, 2021 <br />Page 3 <br />41-1903 Exempt Projects: <br />Clarifies which projects <br />are not subject to the <br />ordinance <br />41-1904 In -Lieu Fee Option: <br />Revises the in -lieu fee <br />and changes the timing <br />of payment <br />an increase in the density permitted by <br />the General Plan. <br />Pending City Council direction, this <br />section will also be amended with one of <br />two options for applicability of the <br />Ordinance between projects that have <br />received entitlement approvals and <br />projects that been issued a building <br />permit/paid the HOO in -lieu fee. <br />In an effort to incentivize the <br />construction of extremely low-income <br />units the amendment also adds a <br />percentage of rental units that may be <br />built on -site for extremely low-income <br />households equal to 5 percent of the <br />total number of units. <br />This section is amended to delete the <br />language regarding applications <br />deemed complete prior to November 28, <br />2011 and further clarify the exclusions to <br />the HOO that may be agreed upon by <br />City Council in a development <br />agreement. <br />This section is amended to increase the <br />in -lieu fee from $5 per habitable square <br />foot to $15 per habitable square foot. <br />This section also removes the incentive <br />for "Entitled Residential Projects" to <br />obtain building permits during the <br />current economic climate. The <br />provision for "Entitled Residential <br />Projects" no longer applies after <br />October 1, 2021. <br />The amendments also extend the timing <br />of payment from issuance of the building <br />permit to issuance of the certificate of <br />occupancy, allowing a developer the <br />oation to aav after the oroiect is <br />City Council 35 — 3 9/7/2021 <br />
