oSURANCE ON FILE N-2021.179-01 <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />S. l 22 <br />CLERK OF COUNCIL <br />DATE' <br />FIRST AMENDMENT TO AGREEMENT <br />APR 1 9 2022 FOR MEDICAL SERVICES AND TESTING <br />THIS FIRST AMENDMENT to the above -referenced agreement is entered into on April V �, <br />2022 by and between William H. Nuesse, M.D. and Mary Ann Nuesse, D.O., a California medical <br />corporation, doing business as Sunrise Multispecialist Medical Center ("Consultant"), and the City <br />of Santa Ana, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California ("City"). <br />RECITALS <br />A. The parties entered into Agreement #N-2021-179, dated September 14, 2021, by which <br />Consultant agreed to provide non -industrial medical services including but not limited to <br />Department of Transportation ("DOT") mandated services, drug tests, respiratory fitness tests, <br />vision testing, post -accident testing, pre -employment examinations, fitness for duty <br />examinations, and similar medical services for employees or applicants for employment. <br />("Agreement"). The Agreement continues through August 11, 2024, and is current and in - <br />effect. <br />B. In its efforts to combat and meet safety requirements related to the ongoing COVID-19 <br />pandemic, City has engaged Consultant to provide mandated daily testing for COVID-19 for <br />the City's correctional officers. <br />C. The parties now wish to increase the compensation for the Agreement to cover the costs <br />required for this increased testing related to COVID-19. <br />The Parties therefore agree: <br />1. Section 2.a, Compensation, is amended to increase the total amount to be expended under the <br />Agreement by twenty-five thousand dollars ($25,000.00). The total amount for services to be <br />provided under this Agreement shall not exceed seventy-five thousand dollars ($75,000). <br />2.
