COMMERCIAL GENERAL LIABILITY <br />CG 01 68 1120 <br />THIS ENDORSEMENT CHANGES THE POLICY. PLEASE READ IT CAREFULLY. <br />MICHIGAN CHANGES <br />This endorsement modifies insurance provided under the following: <br />COMMERCIAL GENERAL LIABILITY COVERAGE PART <br />ELECTRONIC DATA LIABILITY COVERAGE PART <br />POLLUTION LIABILITY COVERAGE PART <br />PRODUCTS/COMPLETED OPERATIONS LIABILITY COVERAGE PART <br />A. The paragraph relating to prejudgment interest in <br />Supplementary Payments, Section I, is replaced <br />by the following: <br />Prejudgment interest awarded against the insured <br />on that part of the judgment we pay. <br />B. With respect to the Duties Condition, Section IV: <br />1. Notice given by or on behalf of the insured to <br />our authorized agent, with particulars sufficient <br />to identify the insured, shall be considered <br />notice to us. <br />2. The last sentence of Paragraph 2.b. is deleted. <br />3. The reference to Paragraph d. is amended to <br />read Paragraph e. <br />4. The following is added: <br />d. Failure to give any notice required by this <br />condition within the time period specified <br />shall not invalidate any claim made by you <br />if it shall be shown not to have been <br />reasonably possible to give notice within <br />the prescribed time period and that notice <br />was given as soon as was reasonably <br />possible. <br />C. The Criminal Acts Exclusion under Coverage B <br />— Personal And Advertising Injury Liability of <br />the Commercial General Liability Coverage Part is <br />replaced by the following: <br />Criminal Acts <br />"Personal and advertising injury" arising out of a <br />criminal act committed by or at the direction of the <br />insured. <br />However, this exclusion only applies to the extent <br />that the insured: <br />1. Admits, under oath; or <br />2. Is determined in any legal proceeding; <br />to have committed or directed the criminal act. For <br />purposes of this exclusion, a determination in any <br />legal proceeding includes, but is not limited to, a <br />criminal conviction, a judgment, decree, ruling or <br />order pronounced by any court of competent <br />jurisdiction or an order or ruling pronounced by <br />any administrative agency. <br />D. The Criminal Or Fraudulent Acts Exclusion of <br />the Electronic Data Liability Coverage Form is <br />replaced by the following: <br />Criminal Or Fraudulent Acts <br />"Loss of electronic data" arising out of a criminal or <br />fraudulent act committed by or at the direction of <br />the insured. <br />However, with respect to "loss of electronic data" <br />arising out of a criminal act, this exclusion only <br />applies to the extent that the insured: <br />1. Admits, under oath; or <br />2. Is determined in any legal proceeding; <br />to have committed or directed the criminal act.
