D. Deductible <br />1. The terms and conditions of this insurance, including the Duties In The Event Of Loss provision, apply <br />regardless of whether the Deductible amount applies to any loss or damage covered under this policy. <br />2. We may pay any part or all of the deductible amount to effect settlement of any claim or suit and, upon notification <br />of the action taken, you shall promptly reimburse us for such part of the deductible amount as has been paid by <br />us. <br />E. Protection And Preservation Of Property <br />1. You must take all reasonable actions to avoid or reduce any: <br />a. Loss or damage to Covered Property; and <br />b. Circumstances likely to cause loss or damage to Covered Property; and <br />c. Circumstances likely to result in a claim under this policy. <br />2. We will pay the reasonable and necessary costs incurred for such actions to temporarily protect or preserve <br />Covered Property, provided such actions are necessary due to actual or imminent physical loss or damage due to <br />a Covered Cause of Loss to such Covered Property <br />3. This provision does not increase the Limit Of Insurance, and we will not pay more for loss than the amount that <br />would have been payable if you had not incurred such costs. <br />F. Conformity To Law <br />If any part of this policy is in conflict with local, state or federal law, those provisions in conflict will automatically <br />change to conform to the law. <br />G. Definitions <br />1. "Continuity" means costs incurred to match or maintain the environment of the "insured production" during <br />"principal photography". The environment includes the weather, climate, natural lighting or seasonal changes <br />under which you are filming the "insured production". <br />2. "Gross production costs" means all costs incurred by you during the policy period except: <br />a. Administrative costs not directly related to an "insured production"; <br />b. Any cost you did not initially incur or report as a cost directly related to the "insured production"; and <br />c. Any other costs specifically stated not to be "gross production costs" in an endorsement to this policy. <br />3. "Insurable production cost' includes: <br />a. All costs, including overhead, chargeable directly to an "insured production" or series of productions, including <br />any amount of other overhead you declare at the time you declare an "insured production" or series of <br />productions. <br />However, the following costs will not be included in "insurable production cost': <br />(1) Royalties, residuals, premiums paid for this insurance, interest on loans, and personal and real property <br />taxes; <br />(2) Story, scenario, music rights, and sound rights, except with respect to television series, specials and <br />pilots; and <br />(3) "Continuity". <br />You have the option to include the costs described in subparagraphs (1), (2) and (3) above at the time you <br />declare an "insured production" or series of productions. In that case, such costs will be included in the <br />"insurable production cost". <br />b. The amount of any loss or damage paid under this policy.
