9.1 The Contractor shall protect City and/or private property adjacent to work areas including sprinkler <br />systems, drain pipes, lawns, brick work, plantings, masonry work, fences, walls, sidewalks, street <br />paving, etc., located on either public or private property. Contractor shall, at its expense, replace <br />any property that is removed or damaged, other than property pre -approved for removal. <br />Contractor shall abide by the City's "Policy for Driving on Park Property" (See Attachment 4). <br />10. TRAFFIC CONTROL <br />10.1 The Contractor will not interrupt traffic flow on City streets without obtaining a no -fee permit <br />from the City. Prior to performing maintenance activities where Contractor employees work <br />immediately adjacent City vehicular lanes or any other situation covered under the California <br />MUTCD, the Contractor shall implement no -fee permitted City approved traffic safety plans to <br />protect the health and welfare of its employees and the general public prior to commencement of <br />the agreement. <br />11. MONTHLY REPORTS <br />11.1 Prior to the first of each month the Contractor shall submit to the Director's Representative for <br />approval: 1) the Excel Park Maintenance Inspector's Inspection Schedule including a detailed <br />annual, monthly, weekly and daily work schedules consistent with task frequencies in Exhibit A; <br />2) certified payroll of employees assigned to the contract areas; 3) organizational chart or equal <br />listing the names, titles, schedules and assignments of all persons working on the project; 4) <br />invoices and packing slips of name, type and quantities of commodities purchased; 5) a detailed <br />description of area deficiencies; and, 6) a record of legal disposal of infectious waste materials. <br />The information contained in the above referenced documents shall be updated with any new <br />information as changes occur. The Director's Representative shall be immediately notified of any <br />changes to the above information. Failure to submit a report by the first of each month shall result <br />in a fine of $100.00 per day for each report submitted late. <br />12. WATER CONSERVATION & PROGRAMMING OF CONTROLLERS <br />12.1 The City shall be responsible for providing water for the Contractor to perform pavement cleaning <br />and infectious waste removaUdisposal services. The Contractor shall be responsible for conserving <br />water when and wherever possible. <br />
