INSURANCE NOT ON FILE <br />WORK MAY NOT PROCEED <br />CLERK OF COUNCIL <br />DATE: <br />N-2022-251 <br />AGREEMENT WITH VOLCAN ADVERTISING AND ENTERTAINMENT TO <br />B :(���)(A,ROVIDE LIVE PERFORMANCES AT CITY'S FIESTAS PATRIAS EVENT <br />LOWIL <br />THIS AGREEMENT is made and entered into this Co day of S&A, kM bvr' 2022, by and <br />California <br />between Volcan Advertising and Entertainment, a corporation ("Contractor"), and the <br />o City of Santa Ana, a charter city and municipal corporation organized and existing under the <br />AConstitution and laws of the State of California ("City"). <br />O <br />o RECITALS <br />uJ <br />A. The City desires to retain a contractor to provide live performances at the City's <br />Fiestas Patrias Event on September 17 & 18, 2022. <br />B. Contractor represents that Contractor is able and willing to provide such services to <br />the City. <br />C. In undertaking the performance of this Agreement, Contractor represents that it is <br />knowledgeable in its field and that any services performed by Contractor under this <br />Agreement will be performed in compliance with such standards as may reasonably <br />be expected. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />a. Contractor shall provide a performance by musical artist Beatriz Adriana <br />("Artist"), as further detailed in Exhibit A, for the City's Fiestas Patrias Event on <br />September 17, 2022. Contractor shall ensure that Beatriz Adriana provides a sixty <br />(60) minute live musical performance, beginning at or around 8:00 p.m. PST at <br />the location specified, in writing, by City staff. <br />b. Contractor shall provide a performance by musical artist El Chapo de Sinaloa <br />("Artist" or collectively as "Artists"), as further detailed in Exhibit B, for the <br />City's Fiestas Patrias Event on September 18, 2022. Contractor shall ensure that <br />El Chapo de Sinaloa provides a sixty (60) minute live musical performance, <br />beginning at or around 7:00 p.m. PST at the location specified, in writing, by City <br />staff. <br />d. Contractor must provide song list of family friendly, clean edit songs with lyrics <br />to be approved by the City of Santa Ana prior to performance. <br />2. COMPENSATION <br />a. City agrees to pay, and Contractor agrees to accept as total payment for its services <br />for City, including all travel expenses and performances by Artists, the rates and <br />Page 1 of 10 <br />
