employee cashes out their eligible leave bank balances prior to retirement <br />and subsequently remains employed one (1) year after their initial notice <br />of intent to retire, said employee shall be ineligible to accrue one hundred <br />(100) hours of management vacation the next calendar year. <br />11.2 Bereavement Leave. An employee shall be granted up to three (3) days leave without <br />loss of pay in case of death of a member of the employee's immediate family. For <br />purposes of this Section only, a "day" shall be defined as the number of hours of work <br />that an employee is required to work according to his/her specific workday schedule. <br />Such leave is designated as bereavement leave. "Immediate family" as used in this <br />section is limited to: <br />A. Any relative by blood or marriage who is a member of the employee's household; <br />B. A parent, parent -in-law, spouse, child, brother, sister, grandparent, or grandchild <br />of the employee, regardless of residence; <br />C. Any other relative of the employee by blood or marriage where it can be <br />established by the employee that as a result of such relative's death, the <br />employee's presence is required. <br />11.3 Military Leave. <br />A. Proof of Orders and Reinstatements. An employee shall be granted military leave <br />if they furnish the Executive Director of Human Resources satisfactory proof of <br />their order to report for duty. Upon return and upon showing of proof of actual <br />service pursuant to such orders, they will be reinstated as provided in Section 9- <br />143 of the Civil Service Rules and Regulations of the City of Santa Ana. <br />B. Temporga. Members of the reserve forces of the United States or the National <br />Guard, granted temporary leave when ordered to duty, in accordance with the <br />Military and Veterans Code, will be granted leave with pay not to exceed thirty <br />(30) working days in each calendar year after one (1) years' service with the City <br />upon presenting satisfactory proof of orders to and from such temporary active <br />duties. <br />11.4 Jury and Witness Leave. When an on -duty employee is called to serve as a juror or <br />witness in any court action, they shall be allowed to leave for the time actually required <br />for such service without loss of pay. Each on -duty employee called for such service shall <br />present to the Police Chief for examination the subpoena calling them to such service and <br />shall pay into the City Treasury the fees collected for such service, with the exception of <br />reimbursement for transportation expenses, if any. <br />11.5 Examination Leave. Employees participating in examinations conducted during their <br />normal working hours for positions in the competitive service of the City of Santa Ana <br />31 <br />City Council 23 — 33 11/15/2022 <br />
