Planning and Building Agency <br />www.santa-ana.org/planning-and-building <br />Item # 48 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br />Staff Report <br />June 6, 2023 <br />TOPIC: Sunshine Ordinance Amendments — 2nd Reading <br />AGENDA TITLE <br />Ordinance Amendment No. 2023-01 amending Article 11.11 of Chapter 2 (Sunshine <br />Ordinance) of the Santa Ana Municipal Code Related to Noticing, Meeting Format, and <br />Transparency Measures for Community Meetings for Certain Development Projects <br />RECOMMENDED ACTION <br />Conduct a second reading and adopt Ordinance Amendment No. 2023-01 amending <br />Section 2-153 in Article 11.11 of Chapter 2 of the Santa Ana Municipal Code (SAMC). <br />DISCUSSION <br />At its May 16, 2023, regular meeting, the City Council approved the first reading of an <br />ordinance approving Ordinance Amendment No. 2023-01 (OA-2023-01) as presented <br />by staff, with three amendments requested by City Council, by a vote of 6-0 (Hernandez <br />absent). Amendments requested by the City Council to the staff -presented ordinance <br />include revising section 2-153(b) to reference the required information needed before <br />deeming an application complete, revising section 2-153(c)(3) to clarify that the meeting <br />notice is to be posted to the City's development project webpage, and revising section <br />2-153(g) to strike the "at minimum" text from the presentation requirements. All three <br />City Council -requested amendments to the staff -presented ordinance are highlighted in <br />Exhibit 2. <br />In summary, the ordinance amendments include increasing the community notification <br />radius from 1,000 feet to 2,000 feet, requiring video and audio recording of meetings, <br />standards for community meeting content and format, and clarifications to the <br />community meetings processes. <br />ENVIRONMENTAL IMPACT <br />The City Council finds and determines that this ordinance is not subject to the California <br />Environmental Quality Act (CEQA). Pursuant to CEQA and the CEQA Guidelines, the <br />adoption of this Ordinance is exempt from CEQA review pursuant to sections <br />15061(b)(3) and 15061(b)(5) of the CEQA Guidelines because it will not result in a <br />direct or reasonably foreseeable indirect physical change in the environment, as there is <br />City Council 48 — 1 6/6/2023 <br />
