Recruitment/ The responsibility to admit students rests solely with the Executive Director anc <br />Advertising/ Admissions staff. Recruitment and Admissions of students are never delegated to ar <br />Promotional Practice outside party. All applications need to be approved and signed by the Executive Director. <br />Policies <br />Prohibited Admissions Activities <br />1. Off -Campus Recruiting: California law (and in some cases Federal law) prohibits <br />off -campus solicitation of enrollments through such methods as canvassing, <br />surveys, telemarketing, referring individuals to Learnet, etc., and registering or <br />enrolling a student off -campus, unless the individual (or Agency) is bonded and <br />licensed as an Agent with the California Bureau for Private Postsecondary <br />Education. Note: This does not apply to Learnet employees who participate in <br />panels such as academic and professional career days at a local high school. <br />2. Employment Agencies may not be used for recruiting. <br />3. Students may not be compensated for referrals (except under strict conditions). <br />Also, a recent statement by the Bureau of Private Postsecondary Education has <br />indicated that such compensation would be considered as rendering the student <br />an "Agent" of Learnet. <br />4. Advertising in the Classifieds section of a newspaper (or any other media) is <br />strictly forbidden. <br />5. No claims Implying a guarantee of employment or level of Income may be made. <br />6. No claims implying that a course of study will prepare an individual for gainful <br />employment or State licensure may be made unless they are factual. <br />Learnet strictly follows advertising/promotional practice guidelines of its approving and/or <br />accrediting agencies, institutions, bodies, and/or organizations. <br />Statement of Assurance The Code of Federal Regulations (38 CFR 21.4201) states VA shall not approve the <br />of Compliance with 85/15 enrollment of any VA -eligible person, not already enrolled, in any course for any period <br />Enrollment Ratios during which more than 85 percent of the students enrolled in the course are having all or <br />part of their tuition, fees, or other charges paid to or for them by an Educational Institution <br />or VA. <br />Public Law 115-407, In accordance with the Veterans Benefits and Transition Act of 2018, section 3679(e) of <br />Section 103 title 38 (Public Law 115-407), a student who is entitled to educational assistance under <br />Chapter 31, Vocational Rehabilitation & Employment, or Chapter 33, Post-9/11 GI Bill® <br />benefits shall be permitted to attend or participate in the course of education during the <br />period beginning on the date on which the individual provides to the educational <br />institution a Certificate of Eligibility for entitlement to educational assistance under <br />Chapter 31 or 33 (a "Certificate of Eligibility" can also Include a "Statement of Benefits" <br />obtained from the Department of Veterans Affairs' website — eBenefits, or a VAF 28-1905 <br />form for Chapter 31) and ending on the earlier of the following dates: <br />• The date on which payment from VA is made to the institution, <br />• 90 days after the date the institution certified tuition and fees following the <br />receipt of the Certificate of Eligibility. <br />The school shall not impose any penalty, including the assessment of late fees, the denial <br />of access to classes, libraries, or other institutional facilities, or require the student to <br />borrow additional funds, in order to meet his or her financial obligations to the institution <br />due to the delayed disbursement funding from VA under Chapter 31 or 33. <br />Last Revision Date <br />
