TO <br />PROVIDE LAKE ENGINEERING SERVICES <br />00 <br />THIS FIRST AMENDMENT to the above -referenced agreement is entered into on April 18, <br />2023, by and between J. Smith & T. Muli, Inc., a California corporation ("Consultant"), and the <br />a City of Santa Ana, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California ("City"). <br />o V9w A ( 0aoial Q(3M)Z <br />RECITALS <br />A. The parties entered into Agreement No. N-2022-159 ("Agreement") dated May 20, 2022, to <br />retain a qualified consultant to provide lake engineering services for the Centennial Park <br />Lake Renovation Project. <br />B. The Agreement is in full force and effect through December 31, 2023. <br />C. The parties now wish to amend the Agreement to increase the compensation under the <br />Agreement. <br />The Parties therefore agree: <br />1. Section 2.a., Compensation, is hereby amended to increase the total amount to be <br />expended under the term of the Agreement by $11,500.00. The total not -to -exceed amount of the <br />Agreement shall be $61,391.00. <br />2.
