Section 2. The City has declared Marko to be surplus property and due to the <br />nature of Officer's relationship with Marko, the City Council authorizes the City Manager <br />to enter into an Agreement with Officer on behalf of the City to sell Marko for $1.00 (one - <br />dollar) under terms and conditions acceptable to the City Attorney. <br />Section 3. The City hereby accepts the donation of Wick, to its ranks, and the <br />equipment and supplies for this K-9. <br />Section 4. If any surcharge or fee, section, subsection, sentence, clause, phrase <br />or word of this Resolution is for any reason held to be invalid by a court of competent <br />jurisdiction, such decision shall not affect the validity of the remaining portions of this <br />Resolution. The City Council hereby declares that it would have passed and adopted <br />this Resolution, and each and all provisions hereof, irrespective of the fact that one or <br />more provisions may be declared invalid. <br />Section 5.
