Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) NEGATIVE DECLARATION <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 6-20 ©Best Best & Krieger LLP <br />• The project would not result in or have the potential to result in harm, harassment, <br />or take of any fish and/or wildlife species. <br />• The project would not result in or have the potential to result in direct or indirect <br />destruction, ground disturbance, or other modification of any habitat that may support fish and/or <br />wildlife species. <br />• The project would not result in or have the potential to result in the removal of <br />vegetation with potential to support wildlife. <br />• The project would not result in or have the potential to result in noise, vibration, <br />dust, light, pollution, or an alteration in water quality that may affect fish and/or wildlife directly <br />or from a distance. <br />• The project would not result in or have the potential to result in any interference <br />with the movement of any fish and/or wildlife species. <br />Any request for a fee exemption should include the following information: <br />(1) the name and address of the project proponent and applicant contact information; <br />(2) a brief description of the project and its location; <br />(3) site description and aerial and/or topographic map of the project site; <br />(4) State Clearinghouse number or county filing number; <br />(5) a statement that an Initial Study has been prepared by the City to evaluate the <br />project’s effects on fish and wildlife resources, if any; and <br />(6) a declaration that, based on the City’s evaluation of potential adverse effects on fish <br />and wildlife resources, the City believes the project will have no effect on fish or <br />wildlife. <br />If insufficient documentation is submitted to DFW for the proposed project, a no effect <br />determination will not be issued. (A sample Request for Fee Exemption is attached as Form “L”.) <br />DFW will review the City’s finding, and if DFW agrees with the City’s conclusions, DFW will <br />provide the City with written confirmation. Retain DFW’s determination as part of the <br />administrative record; the City is required to file a copy of this determination with the County after <br />project approval and at the time of filing of the Notice of Determination. <br />The Lead Agency must have written confirmation of DFW’s finding of “no impact” at the <br />time the Lead Agency files its Notice of Determination with the County. The County cannot accept <br />the Notice of Determination unless it is accompanied by the appropriate fee or a written no effect <br />determination from DFW.
