Local Guidelines for Implementing the <br />California Environmental Quality Act (2023) ENVIRONMENTAL IMPACT REPORT <br /> <br /> <br />2023 City of Santa Ana Local Guidelines 7-3 ©Best Best & Krieger LLP <br />7.04 SPECIAL NOTICE REQUIREMENTS FOR AFFECTED MILITARY AGENCIES <br />CEQA imposes additional requirements to provide notice to potentially affected military <br />agencies when: <br />(a) A “military service” (defined in Section 11.42 of these Local Guidelines) has provided the <br />City with its contact office and address and notified the City of the specific boundaries of <br />a “low-level flight path” (defined in Section 11.37 of these Local Guidelines), “military <br />impact zone” (defined in Section 11.41 of these Local Guidelines), or “special use <br />airspace” (defined in Section 11.67 of these Local Guidelines); and <br />(b) The project meets one of the following criteria: <br />(1) The project is within the boundaries specified pursuant to subsection (a) of this <br />guideline; <br />(2) The project includes a general plan amendment; <br />(3) The project is of statewide, regional, or area-wide significance; or <br />(4) The project relates to a public use airport or certain lands surrounding a public use <br />airport. <br />When a project meets these requirements, the City must provide the military service’s <br />designated contact with any Notice of Preparation, and/or Notice of Availability of Draft EIRs that <br />have been prepared for a project, unless the project involves the remediation of lands contaminated <br />with hazardous wastes and meets certain other requirements. <br />The City must provide the military service with sufficient notice of its intent to certify an <br />EIR to ensure that the military service has no fewer than thirty (30) days to review the document; <br />or forty-five (45) days to review the environmental documents before they are approved if the <br />documents have been submitted to the State Clearinghouse. <br />It should be noted that the effect, or potential effect, a project may have on military <br />activities does not itself constitute an adverse effect on the environment pursuant to CEQA. <br />(Reference: Pub. Resources Code, §§ 21080.4, 21092; Health & Safety Code, §§ 25300, et seq., <br />25396, 25187; State CEQA Guidelines, § 15082(a).) <br />7.05 ENVIRONMENTAL LEADERSHIP DEVELOPMENT PROJECT. <br />Under certain circumstances, a project applicant may choose to apply to the Governor of <br />the State of California to have the project certified as an Environmental Leadership Development <br />Project. A project may qualify as an Environmental Leadership Development Project if it is one <br />of the following: <br />(1) A residential, retail, commercial, sports, cultural, entertainment, or recreational use <br />project that meets the following standards:
